The Regional Municipality of Peel

A by-law to amend By-law 34-2018, being a by-law to regulate the closing of business establishments within the Regional Municipality of Peel on a holiday.
Whereas, the Council of The Regional Municipality of Peel enacted By-law 34-2018 as amended by By-law 61-2019, pursuant to Section 1.2 of the Retail Business Holidays Act (the “Act”) and Section 148 of the Municipal Act, 2001 to provide that the Act does not apply to The Regional Municipality of Peel, and to regulate the closing of business establishments within The Regional Municipality of Peel on a holiday;
And whereas, pursuant to the Plan to Protect Ontario Act (Budget Measures), 2026, a by-law respecting the closing of retail business establishments on a holiday is of no effect to the extent that it provides for the closing of establishments on Family Day or Victoria Day;
And whereas, the Council of the Regional Corporation wishes to make amendments to By-law 34-2018;
And whereas, the Council of the Regional Corporation has by resolution adopted on May 28, 2026, authorized the enactment of the by-law herein to amend By-law 34-2018;
Now therefore, the Council of the Regional Corporation enacts as follows:
- That subsection 1.(1) (Definitions) of Schedule “A” to By-law 34-2018 be amended by deleting the words “Family Day” and “Victoria Day” from the definition of “Holiday”.
- That subsection 4.(8) (Retail Establishments and Areas in the Local Municipal Tourism Strategy) of Schedule “A” to By-law 34-2018 be amended by deleting any reference to “Family Day”.
That subsection 4.(9)(d) (Grandfathered Exemptions) of Schedule “A” to By-law 34-2018 be deleted in its entirety and replaced with the following:
“(d) By-law 78-2012, amended by By-law 54-2024 (Port Credit Business Improvement Area)”
That Schedule “A” of By-law 34-2018 be amended by adding the following new subsection 4.(9.1) (Grandfathered Exemptions):
“(9.1) Grandfathered exemptions in subsection 4.(9) provide defined exemptions to By-law 34-2018 and do not themselves require a closure of a retail business establishment.
For clarity, as a result of the Plan to Protect Ontario Act (Budget Measures), 2026, a by-law respecting the closing of retail business establishments on a holiday (including By-law 34-2018) is of no effect to the extent that it provides for the closing of establishments on Family Day or Victoria Day.”
- The amendments to By-law 34-2018 contained herein take effect upon the date of enactment of this by-law.
