A by-law to regulate parking and stopping on Regional roads under the jurisdiction of The Regional Municipality of Peel

Whereas, pursuant to Section 102.1(1) of the Municipal Act, 2001, a municipality may require a person to pay an administrative penalty for failing to comply with any by-laws respecting the parking, or stopping of vehicles;

And whereas, Section 3 of Ontario Regulation 333/07 (the “Regulation”) provides that a municipality shall not exercise the power referred to in Section 102.1 of the Municipal Act, 2001 unless the municipality has passed a by-law establishing a system of administrative penalties that meets the requirements of the Regulation;

And whereas, pursuant to Section 12 of the Regulation and Section 391 of the Municipal Act, 2001, a municipality may impose fees or charges in connection with the administration of a system of administrative penalties;

And whereas, the Council of The Regional Corporation on the 24th day of January 2013 passed By-law 15-2013 to consolidate the by-laws that regulate traffic on roads under jurisdiction of The Regional Municipality of Peel;

And whereas, the Council of The Regional Municipality of Peel has by resolution passed on the 9th day of April, 2026, authorized the enactment of a by-law to use an Administrative Monetary Penalty System for area municipalities to enforce parking and stopping infractions on Regional roads.

Now therefore, the Council of the Regional Corporation enacts as follows:

1. That Section 1 of By-law 15-2013 is amended by deleting Subsection (2) therein and substituting the following therefor:

   The provisions of Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 regarding parking and stopping may be enforced by municipal law enforcement officers who shall be appointed by By-laws of the Area Municipalities.

2. That Section 2 of By-law 15-2013 is hereby amended by adding the following terms to Subsection (1) therein:

   “Administrative Fee” means any fees specified in Schedule D of this by-law.

   “Administrative Penalty” means a monetary penalty issued by means of a Penalty Notice, as set out in this by-law for a Contravention of this by-law.

   “Contravention” means a failure to comply with a provision listed in this by-law or outlined in Schedule B and Schedule C of this by-law.

   “Early Payment Rate” means an up to twenty five percent (25%) reduction in the Set Penalty Amount for early payment in accordance with Section 26(10) of this by-law that is payable for Contraventions listed in Schedule B of this by-law.

   “Effective Date of Service” means the date on which service of a Penalty Notice is deemed to be effective in accordance with this by-law.

   “Hearing Decision” means the decision of a Hearing Officer.

   “Hearing Officer” means a person appointed by an Area Municipality in accordance with their respective Screening and Hearing Officer By-laws, to perform the duties of a Hearing Officer in accordance with this by-law, in accordance with O. Reg. 333/07 under the Municipal Act, 2001 and pursuant to the Area Municipality policies.

   “Issuing Officer” means a municipal law enforcement officer appointed by By-laws of the Area Municipalities.

   “Late Payment Fee” means an Administrative Fee established by Council in respect of a person’s failure to pay an Administrative Penalty within the time prescribed by this by-law and listed in Schedule D.

   “MTO Search Fee” means an Administrative Fee authorized by Council for any search of the records of or any inquiry to the Ontario Ministry of Transportation, or related authority for the purposes of this By-law, as listed in Schedule D.

   “Non-Appearance Fee” means an Administrative Fee established by the Region in cases where a person fails to appear, electronically or by other means, at the scheduled time and place for a screening or a hearing before a Screening or Hearing Officer, as listed in Schedule D.

   “NSF Fee” means an Administrative Fee established by the Region with respect to payment by negotiable instrument received from a person for payment of any Administrative Penalty or Administrative Fee, for which there are insufficient funds available in the account on which the instrument was drawn, as listed in Schedule D.

   “Penalty Notice” means notice detailing an Administrative Penalty given to a person pursuant to section 26 of this By-law.

   “Penalty Notice Date” means the date of the Contravention specified on the Penalty Notice.

   “Screening Decision” means a notice which contains the decision made by a Screening Officer.

   “Screening Officer” means a person appointed by an Area Municipality pursuant to their respective Screening and Hearing Officer By-law, to perform the duties of a Screening Officer in accordance with this By-law, the Area Municipality By-laws, O. Reg. 333/07 under the Municipal Act, 2001, and pursuant to the Area Municipality policies.

   “Set Penalty Amount” means the amount that is payable in respect of a Contravention of a By-law as identified in Schedule B and Schedule C of this By-law.

   “Vary” means the reduction of an Administrative Penalty amount or extension of time for payment of an Administrative Penalty amount.

3. That Section 2 of By-law 15-2013 is hereby amended by adding the following:

   2(5) Schedule B, Schedule C, and Schedule D referred to in this by-law, shall form part of this by-law and each entry in a Column of Schedule B, Schedule C, and Schedule D shall be read in conjunction with the entry or entries across therefrom, and not otherwise.

4. That Section 19 of By-law 15-2013 is amended by adding the following:

   19 (3) Despite Sections 19(1) and (2) of this by-law, every person who contravenes Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 regarding parking and stopping under this by-law in the geographic areas of the Town of Caledon or the City of Brampton or is the Owner of a vehicle parked or stopped in contravention of Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law in the geographic areas of the Town of Caledon or the City of Brampton shall upon issuance of a Penalty Notice, be liable to pay to the Area Municipality of the geographic area in which the Contravention occurred on the Region’s behalf an Administrative Penalty in the amount specified in Schedule B for Contraventions that occur in the geographic area of the Town of Caledon, and Schedule C for Contraventions that occur in the geographic area of the City of Brampton, of this by-law as applicable for the corresponding prohibited activity, and is subject to the procedures set out in this by-law.

5. That Section 20 of By-law 15-2013 is hereby amended by deleting Subsection (2) therein and substituting the following therefor:

   20.(2) All such penalties prescribed under Section 19(1) and (2) shall be recoverable under the said Provincial Offences Act.

6. That By-law 15-2013 is amended by adding the following:

   ADMINISTRATIVE PENALTY SYSTEM

   1. 26. (1) The parking and stopping provisions set out in Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law applicable to the geographic areas of the Town of Caledon and the City of Brampton are hereby designated as the only parts of this by-law to which a system of Administrative Penalties applies, for the purpose of section 102.1 of the Municipal Act, 2001 and Section 3(1) of O. Reg 333/07.
   2. The parking and stopping provisions set out in Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law applicable to the geographic areas of the Town of Caledon and the City of Brampton may be enforced by an Issuing Officer.
   3. The system of Administrative Penalties for parking and stopping provisions set out in Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law applicable to the geographic areas of the Town of Caledon and the City of Brampton will be administered by the respective Area Municipality of the geographic area in which the Contravention occurred, acting on the Region’s behalf.
   4. The Commissioner, or any individual designated by the Commissioner for this purpose in writing, shall administer all provisions in relation to the administration of the system of Administrative Penalties of this by-law and establish any additional practices and procedures necessary to implement this by-law and may amend such practices and procedures from time to time as the Commissioner deems necessary, without amendment to this by-law, provided that such practices and procedures are not in conflict or inconsistent with this by-law.
   5. For the purposes of Sections 26(11), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26) and (31) of this by-law, the Screening Officers and Hearing Officers appointed by the Area Municipalities pursuant to their respective Screening and Hearing Officer By-laws, as amended from time to time, are hereby appointed as Screening Officers and Hearing Officers respectively of the Region for the geographic areas of the Town of Caledon and the City of Brampton with respect to this by-law.
   6. An Issuing Officer who has reason to believe that a person has contravened the parking and stopping provisions set out in Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law within the geographic areas of the Town of Caledon or the City of Brampton, or that a vehicle has been left parked or stopped in Contravention of the parking and stopping provisions set out in Sections 6(5), 7, 8, 11, 14(1), 14(5) and 25 of this by-law within the geographic areas of the Town of Caledon of the City of Brampton, may issue a Penalty Notice addressed to the person or Owner of a vehicle as soon as reasonably practicable.
   7. No Issuing Officer may accept payment of an Administrative Penalty or Administrative Fee.
   8. The provisions of the Area Municipalities By-laws as amended from time to time governing the information to be included on a Penalty Notice apply with respect to Penalty Notices issued under this by-law within the geographic areas of the Town of Caledon and the City of Brampton, with the exception that the Contravention wording listed in Schedule B for Contraventions occurring in the geographic area of the Town of Caledon and Schedule C for Contraventions occurring in the geographic area of the City of Brampton, to this by-law will be used to describe the particulars of the Contravention.
   9. The provisions of the Town of Caledon By-law 2024-086 for Contraventions occurring in the geographic area of the Town of Caledon, and the provisions of the City of Brampton By-law 333-2013 for Contraventions occurring in the geographic area of the City of Brampton, both of which may be amended from time to time, governing the service of Administrative Penalty documents, apply to the service of Administrative Penalty documents, including a Penalty Notice, under this by-law.
   10. The amount due for a Penalty Notice issued pursuant to Schedule B of this by-law is:
       1. the Early Payment Rate for the related Contravention as set out in Schedule B if payment is received by the Town of Caledon acting on the Region’s behalf within fifteen (15) calendar days from the date of the Penalty Notice being deemed served in accordance with the Town of Caledon’s By-law 2024-086; or
       2. the Set Penalty Amount set out in Schedule B of this By-law for the related Contravention if payment is received by the Town of Caledon acting on the Region’s behalf on and following sixteen (16) calendar days and before the thirtieth (30th) day from the date of the Penalty Notice being deemed served in accordance with the Town of Caledon’s By-law 2024-086; or;
       3. the Set Penalty Amount set out in Schedule B of this by-law, for the related Contravention, plus the Late Payment Fee, and MTO Search Fee as set out in Schedule D if payment is received by the Town of Caledon acting on the Region’s behalf and following thirty-one (31) calendar days from the date of the Penalty Notice being deemed served in accordance with the Town of Caledon’s By-law 2024-086; and
       4. any applicable Administrative Fees as set out in Schedule D of this by-law.
   11. The amount due for a Penalty Notice issued pursuant to Schedule C of this by-law is:
       1. the Set Penalty Amount set out in Schedule C of this by-law for the related Contravention if payment is received by the City of Brampton acting on the Region’s behalf within fifteen (15) calendar days after it becomes due and payable in accordance with the City of Brampton’s By-law 333-2013.
       2. the Set Penalty Amount set out in Schedule C of this by-law for the related Contravention, plus the Late Payment Fee and MTO Search Fee as set out in Schedule D if payment is received by the City of Brampton acting on the Region’s behalf and following thirty-one (31) calendar days after it becomes due and payable in accordance with the City of Brampton’s By-law 333-2013; and
       3. any applicable Administrative Fees as set out in Schedule D of this by-law.
   12. A person who has been issued a Penalty Notice for a Contravention that occurred in the geographic area of the Town of Caledon shall:
       1. Pay to the Town of Caledon acting on the Region’s behalf, the Administrative Penalty within 30 days after the Effective Date of Service; or
       2. Request that the Administrative Penalty be reviewed by a Screening Officer of the Town of Caledon pursuant to the Town of Caledon By-law 2024-086.
   13. A person who has been issued a Penalty Notice for a Contravention that occurred in the geographic area of the City of Brampton shall:
       1. Pay to the City of Brampton acting on the Region’s behalf, the Administrative Penalty within 15 days of the Penalty Notice Date; or
       2. Request that the Administrative Penalty be reviewed by a Screening Officer of the City of Brampton within 15 days after the Penalty Notice Date, and pursuant to the City of Brampton’s By-law 333-2013.
   14. Where a person makes a request for an extension of time for payment, and the request is granted, the date on which the Administrative Penalty is due and payable shall be the date established in accordance with such extension and time.
   15. The provisions of the Town of Caledon By-law 2024-086 as amended from time to time, that permit persons to be excused from paying all or part of the Administrative Penalty, including any Administrative Fees, if requiring them to do so would cause undue hardship, apply within the geographic area of the Town of Caledon.
   16. The provisions of the City of Brampton By-law 333-2013 as amended from time to time, that permit persons to be excused from paying all or part of the Administrative Penalty, including any Administrative Fees, if requiring them to do so would cause undue hardship, apply within the geographic area of the City of Brampton.
   17. A person or Owner who is served with a Penalty Notice may request that the Administrative Penalty be reviewed by a Screening Officer of the Area Municipality of the geographic area in which the Contravention occurred.
   18. The provisions of the Town of Caledon By-law 2024-086, as amended from time to time, governing the review by a Screening Officer, apply to a review by a Screening Officer under this by-law within the geographic area of the Town of Caledon.
   19. The provisions of the City of Brampton By-law 333-2013, as amended from time to time, governing the review by a Screening Officer, apply to a review by a Screening Officer under this by-law within the geographic area of the City of Brampton.
   20. On a review of the Administrative Penalty, a Screening Officer may confirm the Administrative Penalty, or a Screening Officer may cancel, Vary or extend the time for payment of the Administrative Penalty, including any Administrative Fee, in accordance with the Town of Caledon By-law 2024-086 for Contraventions that occurred within the geographic area of the Town of Caledon, or in accordance with the City of Brampton By-law 333-2013 for Contraventions that occurred within the geographic area of the City of Brampton.
   21. The provisions of the Town of Caledon By-law 2024-086 as amended from time to time, allowing a person to obtain an extension of time in which to request a review by a Screening Officer apply to a review by a Screening Officer under this by-law within the geographic area of the Town of Caledon.
   22. The provisions of the City of Brampton By-law 333-2013 as amended from time to time, allowing a person to obtain an extension of time in which to request a review by a Screening Officer apply to a review by a Screening Officer under this by-law within the geographic area of the City of Brampton.
   23. Where a person does not appear for a scheduled review by a Screening Officer, that person shall pay a Non-Appearance Fee as set out in Schedule D of this by-law, as applicable.
   24. A person may request a review of a Screening Decision by a Hearing Officer of the Area Municipality of the geographic area in which the Contravention occurred.
   25. The provisions of the Town of Caledon By-law 2024-086 as amended from time to time, governing the review by a Hearing Officer, apply to a review by a Hearing Officer under this by-law within the geographic area of the Town of Caledon.
   26. The provisions of the City of Brampton By-law 333-2013 as amended from time to time, governing the review by a Hearing Officer, apply to a review by a Hearing Officer under this by-law within the geographic area of the City of Brampton.
   27. On review of a Screening Decision, the Hearing Officer may affirm the Screening Decision, or the Hearing Officer may cancel, Vary or extend the time for payment of the Administrative Penalty, including any Administrative Fee, in accordance with the Town of Caledon By-law 2024-086 for Contraventions that occurred within the geographic area of the Town of Caledon, and in accordance with the City of Brampton By-law 333-2013 for Contraventions that occurred within the geographic area of the City of Brampton.
   28. After a hearing is complete, the Hearing Officer shall issue to the person a Hearing Decision.
   29. The provisions of the Town of Caledon By-law 2024-086 as amended from time to time, allowing a person to obtain an extension of time in which to request a review by a Hearing Officer apply to a review by a Hearing Officer under this by-law within the geographic area of the Town of Caledon.
   30. The provisions of the City of Brampton By-law 333-2013 as amended from time to time, allowing a person to obtain an extension of time in which to request a review by a Hearing Officer apply to a review by a Hearing Officer under this by-law within the geographic area of the City of Brampton.
   31. Where a person does not appear for a scheduled hearing by a Hearing Officer, that person shall pay a Non-Appearance Fee as set out in Schedule D of this by-law, as applicable.
   32. No person shall attempt to, directly or indirectly, communicate with a Screening Officer or a Hearing Officer for the purpose of influencing or interfering, financially, politically or otherwise with respecting the determination of an issue in a proceeding that is or will be pending before the Screening Officer or Hearing Officer, except the person who is entitled to be heard in the proceeding or the person’s lawyer or licensed representative and only by the person or the person’s lawyer or licensed representative during the hearing of the proceeding in which the issue arises.
   33. Nothing in Section 26(32) prevents a Screening Officer or Hearing Officer from seeking or receiving legal advice.
   34. An Administrative Penalty, including any Administrative Fee, that is confirmed or reduced, or in respect of which the time for payment has been extended, and which remains unpaid after the date on which it is due and payable, constitutes a debt to the Region owed by the person to whom the Penalty Notice was issued.
   35. Where a person provides a method of payment to an Area Municipality on the Region’s behalf, for payment of any Administrative Penalty or Administrative Fee, which has insufficient funds available in the account on which the instrument was drawn, the person shall, in addition to the Administrative Penalty and any other fees that may be payable pursuant to this by-law, be liable to pay to the Area Municipality on the Region’s behalf an NSF Fee in the amount specified in Schedule D to this by-law.
   36. Where an Administrative Penalty and any applicable Administrative Fees are not paid after they become due and payable, the Region, or the Area Municipality on the Region’s behalf, may
       1. Notify the Ontario Ministry of Transportation or the Ministry of the Attorney General of the default and the Ministry shall not validate the vehicle permit of the person named in the Penalty Notice nor issue a new vehicle permit to the person until the Administrative Penalty and any applicable Administrative Fees are paid; and
       2. Pursue any other collection mechanisms available to the Region pursuant to the Regulation or at law
   37. Where the Region, or the Area Municipality on the Region’s behalf, notifies the Ministry of a default under Section 26 (36) of this by-law, the person in default shall pay any applicable administrative fee imposed by the Ministry.
   38. Where an Administrative Penalty is cancelled by a Screening Officer or Hearing Officer, any related Administrative Fee is also cancelled.
   39. Any time limit that would otherwise expire on a Saturday, Sunday or a Holiday is extended to the next day that is not a Saturday, Sunday, or a Holiday.
   40. Any amount of any Administrative Penalty or Administrative Fee payable to the Region under this by-law may be collected by the Area Municipality of the geographic area in which the Contravention occurred.

   SEVERABILITY

   27.(1) Should any provision, or any part of a provision, of this by-law, be declared invalid, or to be of no force and effect, by a court of competent jurisdiction, it is the intent of Council that such a provision, or part of a provision, be severed from this by-law and every other provision of this by-law shall be applied and enforced in accordance with its terms to the extent possible according to law.

7. That By-law 15-2013 is amended by adding the following Schedule B containing the Administrative Penalty and Set Penalty Amounts for the parking and stopping provisions of By-law 15-2013 for the geographic area of the Town of Caledon:
