By-Law Number 19-2025
A by-law to amend By-law 45-2023 being a by-law to govern the procurement and disposal of goods and services.
Whereas the Council of the Regional Corporation enacted By-law 45-2023 on October 12, 2023, to govern the procurement and disposal of goods and services;
And whereas, in response to trade tariffs imposed in 2025 by the U.S. on Canadian goods and retaliatory tariffs imposed by Canada on U.S. goods, Regional Council desires the ability to prioritize Canadian and other non-U.S. Goods and Services over those of the U.S. where feasible, in the procurement of Goods and Services, for such time as such tariffs are in effect;
And whereas, the Council of the Regional Corporation has by resolution passed on March 20th, 2025, authorized the enactment of a by-law to amend By-law 45-2023 to enable the prioritization of Canadian and other non-U.S. Goods and Services over those of the U.S. where feasible;
Now therefore, the Council of the Regional Corporation enacts as follows:
That Part XIV (No Local Preference) of By-law 45-2023 be amended by deleting subsection 14.1 and replacing it with the following:
14.1 In alignment with domestic and international trade agreements, Goods and Services shall not be afforded preferential treatment under this By-law or in any Bid Solicitation based on location or origin of the Goods and Services unless otherwise required by law.
14.2 Notwithstanding the above, for the purpose of minimizing exposure to tariffs that have been imposed in 2025 by the U.S. on Canadian goods and retaliatory tariffs imposed by Canada on U.S. goods, the Director of Procurement is authorized to adopt procurement strategies that prioritize Canadian and other non-U.S. Goods and Services over those of the U.S. where feasible, during such time as such tariffs are in effect.
14.3 Where procurement strategies are adopted in accordance with subsection 14.2 above, the procurement of Goods and Services shall be carried out in accordance with such strategies, and the provisions of this By-law shall in all respects continue to apply to such procurements, with all necessary modifications, including the requirement to comply with the thresholds and approval authorities set out in Schedule “B”.
- That this by-law comes into effect on the date it is passed.
