B. DECLARATIONS OF CONFLICTS OF INTEREST

Prior to Delegations/Presentations – Item D1, Councillor Sanderson declared a conflict of interest on Delegations/Presentations – Item D1 and Items Related to Public Works – Item PW-B2 as a family member owns a property in an area included on the Halton-Peel Boundary Area Transportation Study (HPBATS).


C. APPROVAL OF AGENDA

RECOMMENDATION GC-107-2010:

That the agenda for the May 6, 2010, General Committee meeting be amended to withdraw Delegation/Presentations – Items D2 and D3, to be considered at the May 13, 2010 Regional Council meeting;

And further, that the agenda for the May 6, 2010, General Committee meeting be amended to withdraw Delegations/Presentations – Item D4, to be considered at the May 27, 2010 General Committee meeting;

And further, that the agenda for the May 6, 2010 General Committee meeting be amended to bring forward Delegations/Presentations – Item D5, to be dealt with as the first delegation;

D. DELEGATIONS/PRESENTATIONS

D5. Mary Jo Falle, President, Audrey Nichols, Vice-President, Local 966, Canadian Union of Public Employees (CUPE) and Tom Baker, Job Evaluation Representative, CUPE, Presenting Information on Long-Term Care Centres (LTC) Pay Equity

Mary Jo Falle, President, Local 966, Canadian Union of Public Employees (CUPE), stated that CUPE Local 966 settled on a pay equity plan with the Region of Peel some time ago, however, CUPE members working in two Long-Term Care Centres have still not received compensation although the pay equity plan was implemented. She reported that CUPE has been working to resolve the issue but progress has stalled.

Mary Jo Falle questioned why CUPE had not been provided a copy of the Mercer report and offered to work out a settlement with the Region of Peel without having to wait for a ruling from the Pay Equity Commission.

Councillor Sprovieri requested further details on what steps could be taken to resolve the pay equity issues. Tom Baker, Job Evaluation Representative, CUPE, responded that CUPE is waiting for the Region of Peel to provide a copy of the Mercer report. He further stated that the pay equity adjustments made in 2003 should be rolled into the base pay of staff at the Long-Term Care Centres.

Councillor Whitehead arrived at 9:41 a.m.

Councillor Sprovieri asked if the Mercer report could be made available to CUPE representatives. Mike Goldrup, Director of Human Resources, Region Peel, responded that the Mercer report was recently made available to CUPE.

Councillor Sprovieri enquired if the pay equity adjustments made in 2003 could be rolled into the base salary of the affected staff. Mike Goldrup responded that the current pay equity plans must first be renewed before any pay equity adjustments could be made to the base salary of the affected staff.

Councillor Sprovieri sought clarification as to how Regional staff intends to resolve the matter. Mike Goldrup responded that Regional staff will continue to work with CUPE to resolve the matter.

Councillor Saito enquired if the questions and answers outlined in the letter to Regional Chair Kolb dated April 26, 2010 were responded to. Mary Jo Falle responded that CUPE had not received any information related to the questions raised in the letter to Regional Chair Kolb. Janette Smith, Commissioner of Heath Services, undertook to provide CUPE with responses to the questions raised.

Mary Jo Falle thanked Regional Councillors for their support and recognized the quality of service at the two Long Term Care facilities and the outstanding services provided by its management and staff.

Councillor Saito stated that a memo provided to Members of Regional Council from the Commissioner of Health Services indicated that the Mercer report had been made available to CUPE on May 4, 2010. She enquired if Regional staff had received confirmation that the CUPE legal counsel did in fact receive a copy of the Mercer report. Mike Goldrup responded that staff would undertake to confirm that CUPE had received the Mercer report.

D1. Tyrone Gan, Senior Vice President, HDR/iTRANS and Wayne Chan, Manager, Transportation Planning, Presenting the Findings of the Halton-Peel Boundary Area Transportation Study (HPBATS)

Tyrone Gan, Senior Vice President, HDR/iTRANS and Wayne Chan, Manager, Transportation Planning, provided a high level overview regarding the findings from the Halton-Peel Boundary Area Transportation Study (HPBATS). He explained that the purpose of the study was to identify the long term transportation needs within the boundary area and to find options to serve future transportation demands. The study recommends a sustainable transportation strategy built on five pillars:

Councillor Saito expressed concern that the Province of Ontario intends to link eight lanes of traffic into a freeway corridor with current traffic congestion problems. She stated that the Province does not provide financial support to improve the interchange particularly Highways 401 to 25 through Mississauga. Councillor Saito suggested that the Region should recommend that the Province be requested to do the road improvements at major highways where freeway corridor will be linked.

Councillor Saito advised that a meeting was scheduled for June 3, 2010 together with Regional Chair Kolb, Mayor McCallion, representatives from Metrolinx and pertinent Regional and area municipal staff to discuss the issues.

Councillor Thompson expressed concern that truck corridors are aggregate corridors, citing Highway 10, wherein the Province likes to move a lot of aggregates using this Highway and pointed out that trucks contribute to congestion. Councillor Thompson congratulated Halton and Peel staff for the extensive work undertaken to complete the study. He stated that the Province of Ontario should be accountable for the road infrastructure resulting from their policies.

PW-B. TRANSPORTATION

PW-B2. Halton-Peel Boundary Area Transportation Study

Councillor Saito moved the following amendment to the main motion:

RECOMMENDATION GC-108-2010:

That the Province of Ontario be requested to improve Highway 401 through to Highway 25 prior to any future north/south freeway linkages.

The main motion, as amended, was voted upon:

RECOMMENDATION GC-109-2010:

That the recommendations of the Halton-Peel Boundary Area Transportation Study attached as Appendix I to the report of the Commissioner of Public Works, dated April 21, 2010, titled “Halton-Peel Boundary Area Transportation Study,” be endorsed;

And further, that the report prepared by HDR/iTRANS, titled “Halton-Peel Boundary Area Transportation Study,” be approved as a long term transportation master plan for the subject area, with the exception that, although Regional staff will work cooperatively with Hydro One and other public agencies in the planning of infrastructure projects, the references in the report to the location and specific width of a future hydro transmission corridor and right-of-way be removed;

And further, that staff be directed to use the recommendations of the report prepared by HDR/iTRANS, titled “Halton-Peel Boundary Area Transportation Study,” to negotiate resolutions to outstanding appeals related to the Halton-Peel boundary area currently before the Ontario Municipal Board (OMB);

And further, that staff be directed to participate in the formulation of a Memorandum of Understanding in cooperation with the City of Brampton, Region of Halton, and Town of Halton Hills, as well as the Town of Caledon, as they deem appropriate, to establish a framework for the timely implementation of transportation improvements recommended in the Halton-Peel Boundary Area Transportation Study, and which will address:

  a. Transportation corridors in respective Region and Area Municipal Official Plans and zoning by-laws where appropriate, including provisions for schedules for deployment;
     
  b. Context for preparing Terms of Reference for Environmental Assessment studies to implement the recommended transportation improvements based on a systems approach and for establishing proponency.

And further, that staff be directed to update existing corridor protection policies pertaining to the Halton-Peel boundary area contained in the Regional Official Plan and/or prepare new corridor protection policies, to reflect the recommendations of the Halton-Peel Boundary Area Transportation Study;

And further, that the Province of Ontario be requested to improve Highway 401 through to Highway 25 prior to any future north/south freeway linkages;

And further, that staff report back to Regional Council on the outcome of the proposed meetings in Fall, 2010;

And further, that a copy of the subject report be forwarded to the Region of Halton, City of Brampton, City of Mississauga, Town of Caledon, Town of Halton Hills, Ontario Ministry of Transportation and Metrolinx, for information.

Councillor McCallion arrived at 10:34 a.m. due to other municipal business.

David Lyons, Property Owner/Taxpayer, Town of Caledon, highlighted the impacts of the natural heritage designations on privately-owned properties and the agriculture industry, as proposed by ROPA 21B. David Lyons expressed concern that the proposed mapping of a natural heritage corridor on his property will mean that the cost of studies will have to be absorbed by his family to ensure that there is no negative impact to his land should he decide to expand his business. David Lyons stated that regulations and designations will cause sterilization of the industry. He requested that Regional Council urge the Province not to impose the additional costs to the agricultural industry in the Greater Toronto Area (GTA).

Councillor Thompson concurred with David Lyons noting that good management practices should not be penalized. He sought clarification from staff if the Region will be involved with the review of the Provincial Policy Statement with respect to the wording and terminology.

Arvin Prasad, Director, Planning Policy and Research, confirmed that the Region of Peel will be participating in the review of the Provincial Policy Statements and will be consulting with various stakeholders including the Peel Federation of Agriculture.

Councillor Thompson enquired how the Region could correct the mapping. Arvin Prasad responded that mapping has been refined and will continue to be reviewed by Regional staff. He stated that mapping can be revised and does not require an amendment to specific policies in the plan. Arvin Prasad stated that Regional staff will discuss Mr. Lyons’ concerns with provincial staff.

David Lyons stated that property owners would like to have direct involvement and be notified of any changes to regulations that will significantly impact their properties. Provincial staff should communicate with the agricultural community on proposed plans if they want positive outcomes within rural Ontario.

Councillor Paterak suggested that the Province should recognize successful management of agricultural land and farmers should receive consideration for tenure.

D7. Peter Orphanos, Chair, Sierra Club Peel, Regarding Active Recreation Uses in River Valleys and Valley Corridors as it Relates to Regional Official Plan Amendment Number 21B (ROPA 21B)

Peter Orphanos, Chair, Sierra Club Peel, identified that the proposed policy in Regional Official Plan Amendment Number 21B (ROPA 21B) still permits substantial expansion to existing active recreation facilities which is contrary to the Provincial Policy Statement regarding the development in core valleys and valley corridors. He suggested that passive recreation such as walking and biking trails be the highest and best use of the core valley and valley corridors and requested that Item Number 33, Section 2.3.2.16, subsection (a) be amended to exclude the wording “expansions to existing compatible active recreation” and insert the wording “minor alteration to existing active recreation”.

Councillor Mullin inquired if the Conservation Authorities provided comment to the Region of Peel. Arvin Prasad responded that Conservation Authorities and local municipalities were consulted and have approved Section 2.3.2.16 of ROPA 21B. He further stated that the policy was written so that area municipalities can be more restrictive in their respective Official Plans.

Councillor Carlson stated that the Region of Peel Official Plan should be consistent with the area municipalities to avoid appeals at the Ontario Municipal Board. Mark Head, Acting Manager of Rural and Environmental Planning, stated that the section being referred to is consistent with the Official Plans of the area municipalities.

Councillor McCallion noted that should the Region of Peel Official Plan adopt the proposed wording suggested by Sierra Club Peel, the area municipalities will have to conform in their Official Plans. She requested that the amendment being recommended receive public input from affected stakeholders.

D8. Max Harris, Property Owner, Town of Caledon, Regarding Regional Official Plan Amendment 21B (ROPA 21B), Requesting Removal of the Heritage Designation on the Southwest Corner, Part Lot 5, Concession 5 WHS

Max Harris, Property Owner, Town of Caledon, raised concern for the designation of mapping of Natural Heritage on the southwest corner of property which he farmed in the late 1950’s, indicating it will become a centennial farm in 2013. Max Harris wants to restore the farmland as it was in 1913 when purchased by his grandparents. He requested that the farmland be kept in the original state.

Councillor Thompson confirmed that he and Councillor Paterak will be working with the property owner to correct the mapping.

RECOMMENDATION GC-110-2010:

That a permanent easement interest in the lands being Part of Lots 2 and 3 on Registered Plan BR-2 and Part of Lots 4, 5 and 6 on Registered Plan BR-22, City of Brampton, Regional Municipality of Peel, more particularly described as Parts 1, 2, 3, 4 and 5 on Reference Plan 43R-32791 be declared surplus to the needs of the Regional Corporation.

RECOMMENDATION GC-111-2010:

That a permanent easement interest be transferred gratuitously to Hydro One Brampton Networks Inc. for the purpose of laying down, installing and maintaining its lines of electric power and service wires and cables and equipment and all appurtenances and accessories thereto on the lands described as Part of Lots 2 and 3 on Registered Plan BR-2 and Part of Lots 4, 5 and 6 on Registered Plan BR-22, City of Brampton, Regional Municipality of Peel, more particularly described as Parts 1, 2, 3, 4 and 5 on Reference Plan 43R-32791.

MA-B4. Relief of Financial Hardship for Low-Income Seniors and Low-Income Persons with Disabilities

RECOMMENDATION GC-113-2010:

That the necessary by-law be presented to Regional Council for enactment to repeal By-laws 22-2004 and 68-2004 and to establish a by-law to provide relief of financial hardship to low-income seniors and low-income persons with disabilities as required under section 319 of the Municipal Act, 2001, as amended, and to provide for the Regional participation in the tax rebate programs provided by the City of Mississauga, the City of Brampton and the Town of Caledon under section 365 of the Municipal Act, 2001, as amended.

MA-B6. Update and Report on the Association of Municipalities of Ontario Position Paper titled "The Case for Joint and Several Liability Reform in Ontario"

RECOMMENDATION GC-114-2010:

That the position of the Association of Municipalities of Ontario (AMO) that joint and several liability reform is required in Ontario as described in the attached position paper dated April 1, 2010, titled “The Case for Joint and Several Liability Reform in Ontario”, be endorsed;

And further, that the Association of Municipalities of Ontario and the Attorney General for the Province of Ontario be so advised.

Councillor Paterak requested staff to provide more information regarding the implications to the Region of Peel should Bill 16, the Budget Bill, be enacted. Bill 16 is a proposal to amend the Insurance Act that would permit the transfer of the Ontario Health Insurance Plan (OHIP) costs to municipal governments, in cases where municipalities, acting as road authorities, are found to be liable for contributing to an injured party.

Councillor McCallion stated that Bill 16 will significantly impact property taxes and will result in major financial implications to municipalities if it is approved. She stated that the Region should urge the Peel MPPs to support AMO’s position to the Province of Ontario.

HE-C. PUBLIC HEALTH

  HE-C1. Public Health Four-Year Plan, 2010 – 2013

RECOMMENDATION GC-121-2010:

That the service improvements for the “Public Health Four-Year Plan, 2010-2013” be approved in principle, submitted to the Ministry of Health and Long-Term Care as representing the needs of Peel Region, and considered by Regional Council during budget deliberations for 2011, 2012, and 2013;

And further, that the Regionally-funded portion of the approved service enhancements for 2010 be implemented, at a cost of approximately $200,000, to be funded from the 2010 approved divisional budget.

Dr. David Mowat, Medical Officer of Health, provided an overview of the Public Health Four-Year Plan. He reported that historically the provincial government provided 75 per cent of the funding for Public Health programs while municipal governments contributed 25 per cent. It was only recently that the provincial government recognized the rapid population growth in the Region of Peel and increased funding for Public Health programs. Currently provincial funding for the Region of Peel is among the lowest in Ontario. As a result, the provincial government formed a working group to develop a needs-based funding formula that includes per-capita funding adjusted for need.

Dr. Mowat outlined the leading health risks in the Region of Peel as follows:

• Diabetes;
• Dental health status of children;
• Tuberculosis;
• Low birth weights and stillbirths;
• Special needs of immigrant populations; and
• Air quality

Dr. Mowat stated that the Region of Peel developed long term plans to meet the needs of a growing and diverse population in order to comply with provincially-mandated standards. The Region must also make a clear statement to the Province outlining the future Public Health needs and additional funding requirement.

Dr. Mowat described a number of proposed service improvements contained in the Public Health Four Year Plan. These include targeted interventions to address the increasing rates of obesity and diabetes; tobacco use prevention; increased dental screening for children and more inspection of food premises. Peel Public Health will also be required to support the provincial early years initiatives.

Dr. Mowat reported that the Public Health Four-Year Plan identifies a number of urgent needs which include hiring two full-time equivalents to ensure that gains made over the last two years are maintained and to include French school boards and private schools in the data base. Another urgent need indentified in the Public Health Four-Year Plan is to improve monitoring and early detection of diseases in the community such as H1N1. Dr. Mowat recommended that four full-time equivalent positions be added in order to address these two areas of urgent need.

Councillor Sprovieri noted that healthcare costs continue to increase as a part of the overall provincial budget. He stated the importance of developing new strategies to address healthcare challenges in light of the current budgetary deficits faced by the provincial government. Dr. Mowat responded that 40 per cent of the current provincial budget is dedicated to healthcare and that more needs to be done to improve overall public health through education and prevention of diseases such as diabetes.

Councillor Miles stated that failure to address public health issues will result in increased long-term social welfare costs. She stressed the need to continue to apply to the Province for additional funding for public healthcare.

Councillor McCallion asked if the information presented to Council had been made available to the provincial government. Dr. Mowat responded that Peel Public Health continues to raise public health issues with the Minister and Deputy Minister of Long Term Care on an ongoing basis.

Councillor McCallion sought clarification as to whether the provincial government officials are demonstrating an interest in addressing the lack of funding provided for public health in Peel. Dr. Mowat responded that there has not been an official explanation of the reasons behind the funding shortfall but it appears that there is a willingness to address the funding issue.

Councillor McCallion expressed concern that should the Province reduce funding for health programs, the Region would be faced with making up the shortfall in funding or eliminating programs. Dr. Mowat responded that it is difficult to anticipate provincial funding levels however, would be enough flexibility in the funding package to address the financial need for these programs.

Janette Smith, Commissioner of Health Services, stated the provincial government will announce public health funding levels for the year in August, 2010. The four full-time equivalent positions recommended by Dr. Mowat will support existing public health programs and can be funded from the $77 million Public Health budget, should the provincial government reduce funding,

F1. Motion from Mayor McCallion Regarding Eligibility Criteria for the Peace Officer Exemplary Service Medal

RECOMMENDATION GC-124-2010:

Whereas, the federal government created the Peace Officer Exemplary Service Medal in 2004 to recognize peace officers who have provided 20 years of exemplary service;

And whereas, Exemplary Service Medals awarded other professions such as police officers and firefighters make no distinction between federal, provincial and municipal recipients;

And whereas, eligibility for the Peace Officer Exemplary Service Medals is restricted to federal and provincial recipients, which results in situations where Ontario Provincial Police (OPP) special constables, working along side municipal special constables such as in prisoner escorts services, are eligible for the Medal but municipal special constables are not;

And whereas, the criminal code does not distinguish between peace officers who work for a federal, provincial or municipal organization, which could include special constables as employed by the Peel Regional Police, or by-law enforcement officers and animal control officers employed by local municipalities;

Therefore be it resolved, that the Council of the Regional Municipality of Peel urges the Peace Officer Exemplary Service Medal Advisory Committee to reconsider the eligibility criteria for the Medal to extend recognition to peace officers employed by any government organization in Canada;

And further, that the Council of the Regional Municipality of Peel seek the support of the area Members of Parliament for this resolution.
