RECOMMENDATION GC-244-2004:

That the Provincial Ministry of Health and Long Term Care be requested to develop a formula to fairly compensate the Family Physicians who provide medical care and on-call coverage to residents in long term care facilities;

And further, that the Commissioner of Health undertake a review of the Medical Director's role and the Regional fee provided for their services.

PL-A1. Interim Protocol for Land Securement

RECOMMENDATION GC-246-2004:

That the protocol for receiving and reviewing land acquisition funding requests submitted by the Conservation Authorities attached in Appendix I to the report of the Commissioner of Planning, dated November 17, 2004, titled "Interim Protocol For Land Securement" be adopted on an interim basis until a Region of Peel land securement program has been developed;

And further, that staff from the Region of Peel, the Conservation Authorities and Area Municipalities continue to work together to develop a Memorandum of Understanding (MOU) and to examine the staffing and financial implications of developing a Region of Peel land securement program that implements the land securement strategies of the Conservation Authorities;

And further, that staff report back to Regional Council on a protocol for land securement in 2005.

RECOMMENDATION GC-247-2004:

That the purchasing policies set out in the attached draft Schedule "C" to By-law Number 62-2001 as amended, the Purchasing By-law of the Regional Municipality of Peel, be approved;

And further, that the necessary by-law be enacted;

And further, that staff be authorized to develop and/or update where appropriate any purchasing procedures required to give effect to the policies.

MA-B1. Joint Peel-Caledon Accessibility Advisory Committee (AAC) Terms of Reference

RECOMMENDATION GC-248-2004:

That the current term of the Joint Peel-Caledon Accessibility Advisory Committee (AAC) non-elected members be extended from December 31, 2004 to November 30, 2006, to coincide with the term of Regional Council, or until successors are appointed by Regional Council;

And further, that subject to the approval by the Council of the Town of Caledon, the current elected membership be increased by one, and that an Area Municipal or Regional Council member from the City of Brampton be appointed to the AAC, to provide representation by an elected member from each area municipality;

And further, that subject to the approval by the Council of the Town of Caledon, the revised Terms of Reference of the Joint Peel-Caledon Accessibility Advisory Committee (AAC), as recommended by the AAC and attached as Appendix I to the Report of the Commissioner of Corporate Services and Regional Solicitor, dated November 23, 2004, titled "Joint Peel-Caledon Accessibility Advisory Committee (AAC) Terms of Reference", be approved, and that Regional Council Resolutions 2002-1221 and 2003-1168, in so far as they approved the previous Terms of Reference for the AAC, be revoked;

And further, that the subject report be forwarded to the Council of the Town of Caledon for consideration.

RECOMMENDATION GC-249-2004:

That Councillor Gael Miles be appointed to the Chinguacousy Health Services Board for a term ending December 31, 2005, or until a successor is appointed by Regional Council.

RECOMMENDATION GC-250-2004:

That the Commissioner of Corporate Services and Regional Solicitor discuss the feasibility of implementing a 3-1-1 System in Peel with staff from the area municipalities including any potential financial implications, and report back to a future General Committee meeting on the findings.

PL-B1. Regional Official Plan Strategic Update - Regional Official Plan Amendment Proposing Changes to Environmental Mapping - Schedule A (ROPA 13)

RECOMMENDATION GC-251-2004:

That a statutory public meeting be scheduled to commence at 9:30 a.m. on Thursday, January 27, 2005, pursuant to Section 17(15) of the Planning Act to inform the public and to obtain their input with respect to a proposed amendment to the Region of Peel Official Plan (ROPA) as it relates to Schedule A, Core Areas of the Greenlands System in Peel;

And further, that the regularly scheduled Regional Council meeting commence immediately following the public meeting;

And further, that the report of the Commissioner of Planning dated November 16, 2004, titled "Regional Official Plan Strategic Update - Regional Official Plan Amendment Proposing Changes to Environmental Mapping - Schedule A (ROPA 13)" be forwarded to the Ministry of Municipal Affairs and Housing (MMAH), the City of Brampton, the City of Mississauga, the Town of Caledon, Credit Valley Conservation (CVC), the Toronto and Region Conservation Authority (TRCA), and all other municipalities and conservation authorities adjacent to the Region of Peel, for comment;

And further, that a final Region of Peel Official Plan Amendment, which takes into consideration the comments received from the statutory public meeting and public agency consultation, be presented for adoption at a future Regional Council meeting.

PL-C1. Caledon Transportation Needs Study Report

That the report of the Commissioner of Planning, dated November 3, 2004, titled "Caledon Transportation Needs Study Report" and the "Caledon Transportation Needs Study (CATS)" attached as Appendix 1 to the subject report, be received;

And further, that the subject report be used as input to the Transportation Plan Consolidation for Peel Region and Transportation Planning Stream of the Regional Official Plan Strategic Update (ROPSU);

And further, that a copy of the subject report be forwarded to the City of Brampton, City of Mississauga, Town of Caledon, Ontario Ministry of Transportation (MTO), Ontario Ministry of Public Infrastructural Renewal, Region of Halton, County of Wellington, County of Dufferin, County of Simcoe, Region of York, Town of Halton Hills, Town of Erin, Township of East Garafraxa, Town of Orangeville, Town of New Tecumseth, Township of King, and City of Vaughan for their information;

And further, that the Regional Chair write to the Ontario Ministry of Transportation (MTO) and the Ontario Ministry of Public Infrastructure Renewal, requesting the Province to complete the planned construction of the Highway 410 extension, to re-activate the Environmental Assessment (EA) process for the proposed Highway 427 extension as soon as possible, and to work with the municipalities in the affected area to look at shorter term options for an early route selection.


Councillor Saito requested an amendment to the main motion; which carried:

RECOMMENDATION GC-252-2004:

That the matter of funding / cost sharing for the Caledon Transportation Needs Study Report, as well as the transportation studies of the Cities of Brampton and Mississauga be investigated and a report be provided to the January 20, 2005 General Committee Meeting with the appropriate recommendation.

The main motion as amended was then voted upon:

RECOMMENDATION GC-254-2004:

That the User Fees and Charges included in the report of the Treasurer and Commissioner of Finance and the Commissioner of Public Works, dated November 18, 2004, titled "Amendment of Water and Wastewater (Sewer) Systems Fees and Charges", be approved;

And further, that all appropriate by-laws, including By-law 19-77 being the Sewer Charge By-law and By-law 9-73 being the Water Rate Charge By-law, be amended to include the applicable rates as described in the subject report;

And further, that a by-law be presented for enactment establishing the Water Consumption Rate as outlined in the subject report;

And further, that the Water and Wastewater Rates take effect on all water bills rendered on or after April 1, 2005.



PW-B. Engineering and Construction

PW-B1. Implementation of Turn Restrictions for Heavy Trucks at the Intersection of Regional Road 9 (King Street) and Regional Road 50 (Queen Street) - Town of Caledon, Ward 5

RECOMMENDATION GC-255-2004:

That a by-law be enacted to amend Traffic By-law 41-2001 to restrict heavy trucks from turning right or left for all approaches at the intersection of Regional Road 9 (King Street) and Regional Road 50 (Queen Street);

And further, that an additional Part be included in Traffic By-law 41-2001 as Part 19, Turning Movement Restrictions for Heavy Trucks;

And further, that the Ontario Provincial Police (OPP) Caledon Detachment and the Town of Caledon By-law Enforcement Office, be so advised.

PW-B2. Speed Limit Revision on Regional Road 7 (Airport Road), North of Walker Road West to Huntsmill Drive - Town of Caledon, Ward 3

RECOMMENDATION GC-256-2004:

That the existing posted speed limit of 50 km/h on Regional Road 7 (Airport Road) from 260 metres (853 feet) south of Hilltop Drive to 305 metres (1001 feet) north of Walker Road West be extended further north to Huntsmill Drive currently posted as 80 kilometre an hour, in Caledon East, in the Town of Caledon;

And further, that the Ontario Provincial Police be so advised.

RECOMMENDATION GC-257-2004:

That the Region of Peel and the City of Brampton enter into a service agreement to formalize the Region of Peel's responsibility for the collection of municipal waste from roadside litter containers in Brampton, financed from WW70100;

And further, that the Region of Peel and the City of Brampton enter into a service agreement to formalize the Region's commitment to reimburse the City of Brampton for its Vacuum Leaf Collection Program at the Region's contracted yard waste curbside collection cost, financed from WW70120;

And further, that the Region of Peel and the City of Brampton enter into a service agreement for the distribution of Recycling Receptacles by the City at City of Brampton facilities and locations, financed from WW70110;

And further, that the Region of Peel and City of Brampton enter into the aforementioned service agreements for a one year period, which may be renewed for successive one year period(s) at the discretion of Region of Peel and City of Brampton staff;

And further, that all required documents be executed by the Region's duly authorized signing officers.

RECOMMENDATION GC-259-2004:

That the Medical Officer of Health and Commissioner of Health develop a food safety performance disclosure program with the following components:

  • Mandatory posting of green, yellow or red signs, and summary results of the last public health inspection, at the entrance to retail food premises in Peel;
  • Posting summarized food safety performance information on the Regional website; and
  • Posting any convictions for non-compliance with pertinent food safety legislation on the Regional website;

And further, that the costs related to the food safety performance disclosure program development and implementation in the amount of approximately $185,000 be provided for in Public Health's 2005 Current Budget.

HS-G1. Federal Early Learning and Child Care Funding

RECOMMENDATION GC-261-2004:

WHEREAS the Federal-Territorial and Provincial governments have adopted a series of principles, called the QUAD principles, as the basis of an agreement for funding of early learning and child care;

AND WHEREAS, many studies have shown that early learning and child care contributes positively and significantly to a child's development and readiness to learn;

AND WHEREAS, many studies have demonstrated the economic benefits to both the child and the community of early learning and child care programs;

AND WHEREAS, a recent international study of child care services by the Organization of Economic Cooperation and Development (OECD) has shown that Canada has to improve the funding for its early learning and child care programs;

AND WHEREAS, the Federal government has made a commitment to provide additional funding over the next five years for early learning and child care;

AND WHEREAS, the Provincial government in Ontario is expected to release its promised 'Best Start' early learning and child care policy;

AND WHEREAS, the need for additional funding for services for children has been supported by the work of the Fair Share for Peel Task Force;

THEREFORE BE IT RESOLVED THAT the Regional Municipality of Peel petition the Federal Minister of Social Development and Ontario Minister of Children and Youth Services to:

  • increase the funding for child care in an amount sufficient to provide for the needs identified in the municipal Child Care Plans in Ontario,
  • end the requirement for municipal cost sharing of early learning and child care programs in Ontario,
  • adopt the recommendations of the OECD and develop a national early learning and child care program with funding equivalent to other OECD countries.

And further, that the Regional Chair write to the Prime Minister of Canada, the Premier of Ontario, the Federal Minister of Social Development, and the Ontario Minister of Children and Youth Services, to convey the Regional position on the issue of Early Learning and Child Care funding;

And further, that all area MPs and MPPs be copied on the letter from the Regional Chair, and be provided with a copy of the subject report and the resolution of Regional Council;

And further, that a copy of Appendix III to the subject report be circulated to all 47 Consolidated Municipal Service Managers (CMSMs) in Ontario requesting that those Councils adopt the resolution and forward it to their MPs and MPPs;

And further, that a copy of the subject report, resolution and the letter from the Regional Chair be forwarded to the Association of Municipalities of Ontario (AMO), the Ontario Municipal Social Services Association, (OMSSA), and the Canadian Council on Social Development (CCSD), and the Federation of Canadian Municipalities (FCM).

That the current four year Operation and Maintenance Agreement dated June 21, 2002, for the Fewster Drive Material Recovery Facility between the Region of Peel and Waste Management of Canada Corporation (formerly Canadian Waste Services Incorporated), expiring April 30, 2005 be extended by six months until October 31, 2005, at an estimated cost of $2,300,000 (excluding applicable taxes), under Cost Centre WW70210, in accordance with Purchasing By-law 62-2001;

And further, that the operation and maintenance of the Fewster Drive Material Recovery Facility during the extension period be performed at the Processing Fee in effect on April 30, 2005, subject to a one-time price escalation of 8.4 per cent, effective May 1, 2005;

And further, that the current four year Agreement for the provision of urban waste collection services between the Region of Peel and Waste Management of Canada Corporation (formerly Canadian Waste Services Incorporated), expiring April 30, 2005 be extended by eleven (11) months until March 31, 2006, at an estimated cost of $26,300,000 (excluding applicable taxes), under Cost Centres WW70100, WW70110, WW70120, and WW70130, in accordance with Purchasing By-law 62-2001;

And further, that the urban waste collection services provided during the contract extension be performed at the prices in effect on April 30, 2005, subject to a one-time price escalation of 8.6 per cent, effective May 1, 2005;

And further, that additional funding be provided for the Region of Peel to pay a portion of the maintenance costs necessary to extend the life of the current collection vehicle fleet during the 11 month extension period, at a total cost not to exceed $600,000 (excluding applicable taxes) under Capital Project 03-6130 with the necessary funds being financed from the Waste Management Disposal Reserve R1010;

And further, that upon Regional Council approval of the recommendations above, the Region of Peel utilize Waste Management of Canada Corporation permitted transfer stations within the Region of Peel for up to 50,000 tonnes of municipally collected waste, provided that Waste Management of Canada Corporation can fully accommodate and satisfy the terms and conditions of the Region of Peel's existing Haulage and Disposal Agreement with Wilson Logistics Incorporated and Republic Services of Canada Incorporated.

F1. Notice of Motion by Councillor Paterak regarding Dedicated Funding for Land Securement

Moved by Councillor Paterak,
Seconded by Councillor Mullin;

WHEREAS the Province of Ontario through recent initiatives, including the Greenbelt Plan, has indicated the need and desirability of public ownership of more green space for recreational purposes and for the protection of sensitive environmental features;

AND WHEREAS, the Region of Peel supports securement programs through its funding of Conservation Authorities;

AND WHEREAS, the Region of Peel has recognized the need for dedicated funding for these purposes;

THEREFORE BE IT RESOLVED, that the Region of Peel supports the establishment of a source of dedicated funding for land securement by the Province of Ontario as envisioned in the Greenbelt Plan;

And further, that the Region of Peel would support a small increase in the land transfer tax to be dedicated for land securement;

And further, that this resolution be circulated to the Cities of Mississauga and Brampton, the Town of Caledon, the Conservation Authorities, the Ministry of Municipal Affairs and Housing, Ministry of Natural Resources, the Ministry of Environment; the Treasurer of Ontario and the Premier of Ontario.
