WHEREAS under the provisions of section 11(3) of the Municipal Act, S.O. 2001, Chapter 25 as amended, the Council of the Regional Corporation may pass by-laws respecting Highways, including Parking and traffic on Highways, under the jurisdiction of The Regional Municipality of Peel (the “Region”);

AND WHEREAS, the Council of the Region on the 16th day of June, 2005 passed By-law 57-2005 to consolidate the by-laws that regulate traffic on roads under the jurisdiction of the Region;

AND WHEREAS, amending by-laws have been enacted from time to time by the Council of the Region, changing the traffic regulations on the roads under its jurisdiction;

AND WHEREAS, in order to obtain greater efficiency in the administration of the traffic regulations on the Region's roads it is deemed beneficial to further reconsolidate and amend all traffic by-laws;

AND WHEREAS, the Council of the Region has by resolution passed on the 24th day of January, 2013 authorized the enactment of a by-law to consolidate By-law 57-2005 and all amending by-laws and to further amend and update the by-law;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

ENFORCEMENT:

1.	(1)	The provisions of this by-law shall be enforced by the Peel Regional Police and the Ontario Provincial Police.
	(2)	The provisions of Sections 7, 8, 11, 14(1) and 14(5) may be enforced by the Provincial Offences Officers of the Area Municipalities.

INTERPRETATION:

2.	(1)	That in this by-law, the term:
		(a)	"Act" means the Highway Traffic Act, R.S.O. 1990 Chapter H.8 and regulations thereto, as amended;
		(b)	"Area Municipalities" means the City of Mississauga, the City of Brampton, and the Town of Caledon;
		(c)	"bicycle" means a Vehicle propelled or driven by muscular power, and includes a tricycle having a wheel or wheels of more than 60 centimetres in diameter;
		(d)	"commercial Motor Vehicle" means a Motor Vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses and tractors used for hauling purposes on the highways;
		(e)	"Commissioner" means the Commissioner of Public Works for the Region or designate;
		(f)	“Community Safety Zone” means part(s) of a Highway designated as a Community Safety Zone by this by-law where traffic fines have been increased for certain traffic violations, and that is identified by Community Safety Zone signs as prescribed in the Act;
		(g)	“Construction Zone” means any area upon or around any Highway which is clearly marked with the standard construction signing as an area where construction, maintenance, or other work is temporarily being conducted;
		(h)	"Crosswalk" means
			(i)	tthat part of a Highway at an Intersection that is included within the connections of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the curbs, or in the absence of curbs, from the edges of the Roadway, or
			(ii)	any portion of a Roadway at an Intersection or elsewhere distinctly indicated for Pedestrian crossing by signs or by lines or other markings on the surface of the Roadway;
		(i)	“Disabled Person” means an individual who has been issued a Disabled Person’s Parking Permit by the Ministry of Transportation which is valid and which is used and displayed in accordance with the regulations under the Act;
		(j)	“Disabled Person’s Parking Permit” means a valid parking permit issued to a Disabled Person by the Ministry of Transportation under the Act;
		(k)	“Disabled Person’s Parking Space” means a parking space designated by this by-law for use by Disabled Persons;
		(l)	“Footpath” means a type of thoroughfare that is intended for use by Pedestrians but not other forms of traffic, such as Vehicles;
		(m)	"Heavy Truck" means a Commercial Motor Vehicle having a weight when unloaded, of three tonnes or more, or when loaded, of five tonnes or more, but does not include a passenger vehicle, an ambulance or any Vehicle of a police or fire department;
		(n)	"Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for passage of Vehicles and Pedestrians and includes the area between the lateral property lines thereof;
		(o)	"Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more Highways that join one another at an angle, whether or not one Highway crosses the other;
		(p)	“Lane Designation” means the regulation of traffic on an approach by assigning certain traffic movements to specific lanes to an Intersection;
		(q)	“Left Turn Signal” means a separate Traffic Signal Head exclusively for controlling left turn movements;
		(r)	“Motor Assisted Bicycle” means a Bicycle,
			(i)	that is fitted with pedals that are operable at all times to propel the Bicycle,
			(ii)	that weighs not more than 55 kilograms,
			(iii)	that has no hand or foot operated clutch or gearbox driven by the motor and transferring power to the driven wheel,
			(iv)	that has an attached motor driven by electricity or having a piston displacement of not more than fifty cubic centimetres, and
			(v)	that does not have sufficient power to enable the Bicycle to attain a speed greater than 50 kilometres per hour on level ground within a distance of two kilometres from a standing start;
		(s)	"Motor Vehicle" includes an automobile, Motorcycle, Motor Assisted Bicycle, and any other Vehicle propelled or driven other than by muscular power, unless otherwise indicated in this by-law, but does not include a street car, or other motorized vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or a road-building machine within the meaning of the Act;
		(t)	"Motorcycle" means a self-propelled motorized Vehicle having a seat or saddle for the use of the driver and designed to travel on no more than three wheels in contact with the ground, and includes a motor scooter but does not include a Motor Assisted Bicycle;
		(u)	"Official Sign" means any sign or Roadway, curb or Sidewalk marking or other device placed or erected on a Highway under the authority of this by-law and specified in the Ontario Traffic Manual or the Act or otherwise approved by the Council of the Region for the purpose of regulating, warning and guiding traffic;
		(v)	"Park" or "Parking" means the Standing of a Vehicle on a Highway, whether occupied or not, except when Standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers;
		(w)	"Pedestrian" means a person who is walking under his own muscular power, not by Vehicle, and includes a person in a wheelchair, a child in a wheeled carriage, and a person riding a non-motorized Bicycle with wheels less than 60 centimetres in diameter;
		(x)	"Police Officer" means a member of the Peel Regional Police Force or a member of the Ontario Provincial Police Force;
		(y)	"Public Transit Vehicle" means a Motor Vehicle owned and operated by, for, or on behalf of the Region, or any other municipality or provincial authority as part of its passenger transportation services, or Motor Vehicle so designated by the Commissioner of Public Works, designed and operated for the purpose of carrying passengers;
		(z)	"Public Vehicle" means a Motor Vehicle operated on a Highway by, for, or on behalf of the Region, or any other municipality;
		(aa)	“Region” means The Regional Municipality of Peel;
			"Reserved Bicycle Lane" means a section of the street or roadway designated for unidirectional bicycle traffic only and denoted by pavement markings and signage;
		(bb)	“Reserved Bus Lane” means a designated specific lane on a Roadway exclusively for Public Transit Vehicle use;
		(cc)	"Roadway" means that part of the Highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a Highway includes two or more separate Roadways, the term "Roadway" refers to any one Roadway separately and not to all the Roadways collectively;
		(dd)	“Roundabout” means a form of Intersection that accommodates traffic flow in a counter-clockwise direction around a central island;
		(ee)	"Scenic Road" means a Highway which has a significant scenic value and attracts substantial numbers of visitors from within and beyond Regional boundaries and is designated as a Scenic Road by Council of the Region;
		(ff)	"School Bus" means a Motor Vehicle designed and operated for the purposes of transportation of children in accordance with the provisions of the Act, and includes a Motor Vehicle operated by, for, or on behalf of the Peel District School Board and/or the Dufferin-Peel Catholic District School Board;
		(gg)	“School Days” means any Monday to Friday inclusive, when school is normally in session;
		(hh)	“School Zone” means the portion of a Highway that adjoins the entrance to or exit from a school and that is within 150 metres along the Highway in either direction beyond the limits of the land used for the purposes of the school;
		(ii)	“Sidewalk” means that part of a Highway with a surface improved with asphalt, concrete or gravel for the use of Pedestrians;
		(jj)	“Special Event” includes religious or community gatherings, television or commercial production filming, sporting, or social events, and any other event which the Commissioner designates to be a special event;
		(kk)	"Stand" or "Standing" means the halting of a Vehicle on a Highway, whether occupied or not, except for the purpose of, and while actually engaged in receiving or discharging passengers;
		(ll)	"Stop" or "Stopping" means the halting of a Vehicle on a Highway, even momentarily, except when necessary to avoid conflict with other traffic or except in compliance with the directions of a Police Officer or of a Traffic Control Signal or sign;
		(mm)	"Through Highway" means a Highway or part of a Highway designated as such by the Minister of Transportation or by by-law of a municipality, and every such Highway shall be marked by a stop sign or yield right-of-way sign in compliance with the regulations of the Ministry of Transportation;
		(nn)	"Traffic Control Signal" means any power-operated traffic control device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed;
		(oo)	“Traffic Signal Head” means a component of a Traffic Control Signal which has illumination of one or more lenses which conveys a message to traffic approaching the Traffic Control Signal from one direction;
		(pp)	"U-turn" means the turning of a Vehicle within a Highway so as to proceed in the opposite direction;
		(qq)	"Vehicle" includes a Motor Vehicle, trailer, traction engine, farm tractor, road-building machine and any Vehicle drawn, propelled or driven by any kind of power, including muscular power and including the live creature providing the muscular power, but does not include a motorized snow vehicle or a street car.
	(2)	Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be standard time except in periods when daylight savings time is in effect, in which periods it shall be daylight savings time.
	(3)	(a)	Words expressed in the singular number have a corresponding meaning when used in the plural; words used in the masculine gender include the feminine; and words used in the present tense include the future;
		(b)	The term “may” shall be construed as permissive;
		(c)	The term “shall” shall be construed as imperative;
		(d)	The term “subsection” when used without reference to another section, refers to a subsection contained in the same section in which the phrase is used.
	(4)	Schedule A, referred to in this by-law, shall form part of this by-law and each entry in a Column of each Part of Schedule A shall be read in conjunction with the entry or entries across therefrom, and not otherwise.

TRAFFIC SIGNS AND SIGNALS:

3.	(1)	That the Commissioner is authorized to place or erect and to maintain such Official Signs and Traffic Control Signals as are required to give effect to the provisions of this by-law or as are required to warn or guide traffic for the safety or convenience of the public or as are required or recommended or allowed by the Act.
	(2)	No person shall place, maintain or display upon, or in view of, any Highway any sign, signal, marking or device which purports to be or is an imitation of or resembles an Official Sign or Traffic Control Signal or which conceals from view or interferes with the effectiveness of an Official Sign or Traffic Control Signal.
	(3)	The Commissioner is authorized to erect emergency No Parking signs:
		(a)	when in his opinion an emergency has arisen making it desirable to prohibit Parking on a Highway;
		(b)	to facilitate the removal of snow, ice or debris from a Highway;
		(c)	to facilitate the construction or repair of roads, curbs, gutters, sewers and watermains.
	(4)	Emergency No Parking signs may be erected at least one hour before an event commences, and shall be removed within one hour of the termination of an event.
	(5)	No operator of a Vehicle approaching a green or amber signal display of a Traffic Control Signal at an Intersection shall enter the Intersection unless traffic in front of him is moving in a manner that would reasonably lead him to believe he can clear the Intersection before the signal display turns red.
	(6)	Subsection (5) does not apply to the operator of a Vehicle who enters an Intersection for the purpose of turning to the right or left into an intersecting Highway and signals his intention to make such turn prior to entering the Intersection.
	(7)	The Commissioner is authorized to designate the temporary removal or erection of “No Parking” and “No Stopping” signs for Special Events.
	(8)	The Commissioner is authorized to designate a Highway or a portion of a Highway as a Construction Zone and has the authority to set a lower rate of speed for Motor Vehicles driven in the designated Construction Zone.

MISCELLANEOUS DRIVING REGULATIONS:

4.	(1)	The driver or operator of a Vehicle emerging from a driveway, laneway or other egress onto a Highway shall bring the Vehicle to a full stop immediately before driving onto a Sidewalk or Footpath, and upon proceeding shall yield the right-of-way to Pedestrians upon the Sidewalk or Footpath.
	(2)	No person shall drive a Motor Vehicle upon a Sidewalk or Footpath except for the purpose of directly crossing the Sidewalk or Footpath.
	(3)	No person shall drive a Motor Vehicle over a raised curb except at a place where there is a ramp designed for that purpose.
	(4)	No person shall drive any Vehicle in a Roundabout other than in a counter clockwise direction.

PEDESTRIAN REGULATIONS:

5.	(1)	Except where Traffic Control Signals are in operation or where traffic is being controlled by a Police Officer, a Pedestrian crossing a Highway shall yield the right-of-way to all Vehicles upon the Roadway, but nothing in this Section shall relieve the driver of a Vehicle from the obligation of taking all due care to avoid a collision.
	(2)	No Pedestrian shall proceed over or go under a barrier installed on a Sidewalk for the purpose of prohibiting Pedestrian movement.
	(3)	No person shall play, or take part, in any game or sport upon a Roadway.
	(4)	No person on roller skates, or riding in, or by means of, any scooter, toy vehicle or similar device, shall travel on the Roadway except to directly cross the Roadway.
	(5)	When Official Signs are erected and on display, no Pedestrian shall cross any Highway set out in Schedule A of this by-law, Parts 1 and 2, Column 1 between the limits set out in Columns 2 and 3, at the times or days set out in Column 4 of the said Parts.

REGULATIONS FOR BICYCLES:

6.	(1)	A person operating a Bicycle upon a Roadway shall ride as close to the right-hand side of the Roadway as practicable and shall exercise due care when passing a Standing vehicle or one proceeding in the same direction.
	(2)	Persons operating Bicycles upon a Roadway shall ride in single file.
	(3)	No person operating a Bicycle shall carry any package, bundle or article which prevents the rider from keeping both hands on the handle bars.
	(4)	Every person operating a Bicycle shall, at all times when riding on a Highway or Sidewalk, keep his feet on the pedals and both hands on the handlebars, except for the purposes of signalling.
	(5)	No person shall Park a Bicycle on a Highway except in such a manner as to cause the least possible obstruction to Pedestrian or vehicular traffic.
	(6)	When Official Signs are erected and on display, no person operating a Bicycle shall cross any Highway set out in Schedule A of this by-law, Parts 1 and 2, Column 1 between the limits set out in Columns 2 and 3, at the times or days set out in Column 4 of the said Parts.

GENERAL STOPPING AND PARKING REGULATIONS:

7.	(1)	No person shall Park or Stop any Vehicle on any Highway or portion thereof except as follows:
		(a)	where there is a raised curb, on the right side of the Roadway, having regard to the direction such Vehicle was proceeding, with its right front and rear wheels parallel to and not more than 0.15 metres out from such curb;
		(b)	where there is no curb or a rolled curb, with the right front and rear wheels parallel to and as near to the right-hand limit of the Highway as is practicable without Stopping or Parking over a Sidewalk or Footpath or over any part of a Highway where grass is grown or which is not intended for the use of Vehicles.
	(2)	Where parking spaces are designated by lines painted on the Roadway, no person shall Stop or Park any Vehicle except within an area designated as a parking space by painted lines.
	(3)	No person shall Stop a Vehicle on a Highway in any of the following places:
		(a)	on or over a Sidewalk, Footpath or Crosswalk;
		(b)	within an Intersection;
		(c)	alongside or across the Highway from any excavation or obstruction in the Roadway when the free flow of traffic would thereby be impeded;
		(d)	on the Roadway alongside of any stopped or parked Vehicle;
		(e)	upon any bridge or within any tunnel or underpass;
		(f)	on any middle boulevard or centre strip separating two Roadways or adjacent to either side or ends of such middle boulevard or centre strip;
		(g)	on or within a School Bus or Public Transit Vehicle loading zone, unless that Vehicle is a School Bus, Public Transit Vehicle or Public Vehicle engaged in the loading or unloading of passengers.
	(4)	No person shall sell, or offer for sale by retail any goods if the place of offering or sale is on a Highway.
	(5)	No person shall Park a Vehicle on a Highway:
		(a)	for a longer period of time than 3 hours;
		(b)	between the hours of 2:00 a.m. and 6:00 a.m.;
		(c)	in front of or within 6 metres of a driveway or laneway along a Roadway where the posted speed limit is higher than 50 km/h and in front of or within 3 metres of a driveway or laneway along a Roadway where the posted speed limit is 50 km/h or less, or so as to obstruct Vehicles in the use of a driveway or laneway;
		(d)	within 3 metres of a point on the edge of the Roadway and nearest a fire hydrant;
		(e)	within 9 metres of an Intersection as measured from the end of the corner radius;
		(f)	within 15 metres of the nearest rail of any level crossing of a railway;
		(g)	on any Roadway having an overall width of less than 6 metres;
		(h)	in such a position as will prevent the removal of any other Vehicle previously parked;
		(i)	for the purpose of washing, greasing or repairing the Vehicle, except for such repairs as have been necessitated by an emergency;
		(j)	for the purpose of displaying the Vehicle for sale;
		(k)	in such a manner as to interfere with the movement of traffic or the clearing of snow from the Highway;
		(l)	on a Roadway directly opposite a Vehicle stopped or parked on the other side of the Roadway, where the width of the Roadway is less than 9 metres.
	(6)	Where official no parking signs are erected and are on display, no person shall Park any Vehicle on any Highway:
		(a)	within 30 metres of an Intersection as measured from the end of the corner radius;
		(b)	within 25 metres of a bus stop as measured from the post for the bus stop sign;
		(c)	within 7.5 metres of the lot lines of any fire hall on the side of the Highway on which the fire hall is located or within 30 metres of the projected lot lines of such a fire hall on the opposite side of the Roadway;
		(d)	upon that side of a Highway contiguous to any school property, between the hours of 8:00 a.m. to 6:00 p.m., Monday to Friday inclusive;
		(e)	within the following distance of a Crosswalk controlled by Traffic Control Signals and located other than at an Intersection:
			(i)	15 metres of the Crosswalk measured on each side of the Highway in the direction of travel of Vehicles on that side of the Highway, and
			(ii)	30 metres of the Crosswalk measured on each side of the Highway in the direction opposite to the direction of travel of Vehicles on that side of the Highway;
		(f)	along a road where an emergency no parking prohibition is in effect.

STOPPING AND PARKING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS

8.	(1)	Where official disabled person’s parking signs are erected and on display, no person shall Park or Stop a Vehicle on a Highway set out in Schedule A of this by-law, Part 3, Column 1, on the side set out in Column 2, between the limits set out in Columns 3 and 4, at the times or days set out in Column 5 of the said Part, without displaying a Disabled Person’s Parking Permit.
	(2)	Where official no parking signs are erected and on display, no person shall Park a Vehicle on a Highway set out in Schedule A of this by-law, Part 4, Column 1, on the side set out in Column 2, between the limits set out in Column 3 during the prohibited times or days set out in Column 4 of the said Part.
	(3)	Where official no parking signs are erected and on display, no person shall Park a Vehicle on any Scenic Road set out in Schedule A of this by-law, Part 5, Column 1, on the side set out in Column 2, between the limits set out in Column 3 during the prohibited times or days set out in Column 4 of the said Part.
	(4)	Where official no stopping signs are erected and on display, no person shall Stop a Vehicle on a Highway set out in Schedule A of this by-law, Part 6, Column 1, on the side set out in Column 2, between the limits set out in Column 3 during the prohibited times or days set out in Column 4 of the said Part.
	(5)	Where official no stopping signs are erected and on display, no person shall Stop a Vehicle on any Scenic Road set out in Schedule A of this by-law, Part 7, Column 1, on the side set out in Column 2, between the limits set out in Column 3 during the prohibited times or days set out in Column 4 of the said Part.

THROUGH HIGHWAYS, STOP SIGNS AND YIELD SIGNS:

9.	(1)	The Highways set out in Schedule A of this by-law, Part 8, Column 1 between the limits set out in Columns 2 and 3 of the said Part, are, except as provided in subsection (2) of this section, are hereby designated as Through Highways.
	(2)	The designation in subsection (1) of this section of a Highway or portion of a Highway as a Through Highway shall not include any Intersection thereon where the road intersected is a King's Highway or where Traffic Control Signals are installed.
	(3)	The Intersections set out in Schedule A of this by-law, Part 9, Column 1 are designated as Intersections where stop signs shall be erected facing traffic moving in the direction and on a Highway set out in Column 2 of the said Part.

SPEED LIMITS

10.	(1)	The maximum rate of speed on any Highway under the jurisdiction of the Region shall be 50 kilometres per hour, except where Official Signs have been erected and are on display in accordance with the maximum rates of speed prescribed in subsections (2) and (3) of this section.
	(2)	When the Highways set out in Schedule A of this by-law, Parts 10, 11, 12, 13 and 14, Column 1, between the limits set out respectively in Columns 2 and 3 of the said Parts, have Official Signs erected and on display in compliance with the Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the respective Parts, between the times and on the days set out in Column 4.
	(3)	Notwithstanding the maximum rate of speed otherwise provided in this section, where the Commissioner or designate has set a lower rate of speed for Motor Vehicles driven in a designated Construction Zone and the Highway or portion of it has been signed in accordance with the Act, then the maximum rate of speed in the designated Construction Zone shall be as established by the Commissioner pursuant to Section 3 subsection (8).

RESERVED BUS LANES

11.

When official Reserved Bus Lane signs are erected and on display no person shall drive, Park or Stop a Vehicle, other than a Public Transit Vehicle, in any Intersection or a portion of Highway set out in Schedule A of this by-law, Part 15, Column 1, proceeding in the lane set out in Column 2, in the direction set out in Column 3, at the times or days set out in Column 4 of the said Part.

LANE DESIGNATIONS

12.

When official Lane Designation signs are erected and on display, no person shall use any lane contrary to the designation on the Highway as set out in Schedule A of this by-law, Part 16, Column 1, in which the specified Highways have been divided into clearly marked lanes between the limits set out in Column 2 of the side Part, where each of the lanes indicated in Column 3 is designated for traffic moving only in the direction or directions indicated in Column 4 during the times or days indicated in Column 5 of the said Part.

LEFT TURN SIGNALS

13.

When official Left Turn Signal signs are erected and on display, no person shall make a left turn at the Intersection set out in Schedule A of this by-law, Part 17, Column 1, in the direction set out in Column 2 of the said Part, unless otherwise indicated by the Traffic Signal Head which is exclusively controlling left turns.

HEAVY TRUCK TRAFFIC

14.	(1)	Except as provided in subsection (2) of this section, when official Heavy Truck restriction signs are erected and on display, no person shall move, drive, Stop, Park or operate a Heavy Truck, on a Highway set out in Schedule A of this by-law, Part 18, Column 1 between the limits set out in Column 2 during the times or days set out in Column 3 of the said Part.
	(2)	Subsection (1) of this section shall not apply to any Vehicle actually engaged in making a delivery to, or a collection from, premises which cannot be reached except by way of a Highway or a portion of Highway referred to in the said section or to prohibit the use of such Vehicles for such purpose, provided that in making such delivery or collection the said Highway or portion of Highway is travelled only insofar as is unavoidable in getting to and from such premises.
	(3)	When Official Signs are erected and on display, no person shall turn a Heavy Truck in any Intersection or a portion of Highway set out in Schedule A of this by-law, Part 19, Columns 1 and 2, proceeding in the direction set out in Column 3, in making the turn set out in Column 4, during the times or days set out in Column 5 of the said Part.
	(4)	When Official Signs are erected and on display, and with the exception of local deliveries as set out in subsection (2), no person shall turn a Heavy Truck in any Intersection or a portion of Highway set out in Schedule A of this by-law, Part 20, Columns 1 and 2, proceeding in the direction set out in Column 3, in making the turn set out in Column 4, during the times or days set out in Column 5 of the said Part.
	(5)	When official Heavy Truck restriction signs are erected and on display, no person shall move, drive, Stop, Park or operate, a Heavy Truck on a Highway set out in Schedule A of this by-law, Part 21, Column 1, between the limits set out in Column 2, in the lanes set out in Column 3, in the direction set out in Column 4, during the times or days set out in Column 5 of the said Part.

AXLE LOAD WEIGHT RESTRICTIONS

15.	(1)	No Commercial Motor Vehicle or trailer, other than a Public Vehicle or a two axle tank-truck or a two axle truck, while used as referred to in section 122 of the Act, shall be operated or drawn on a Highway set out in Schedule A of this by-law, Part 22, Column 1 between the limits set out in Columns 2 and 3, during the months or times indicated in Column 4 of the said Part or when appropriate signs have been erected, where any axle of such Commercial Motor Vehicle or trailer transmits to the Highways weight in excess of 5,000 kilograms.
	(2)	(a)	Subsection (1) of this section does not apply to prevent the operation of a Commercial Motor Vehicle or trailer on the parts of the Highways described in Schedule A, Part 22 where a special permit has been applied for and obtained from the Commissioner.
		(b)	A special permit may be made subject to such terms and conditions as the Commissioner is authorized to designate appropriate.

TURNING MOVEMENTS PROHIBITED

16.	(1)	Where U-turns are not prohibited under the provisions in subsection (2) of this section, such a turn shall be made (subject to section 143 of the Act) only where it can be made in safety and without interfering with other traffic.
	(2)	When official turn control signs are erected and on display, no person shall turn a Vehicle in any Intersection or a portion of Highway set out in Schedule A of this by-law, Part 23, Column 1, proceeding in the direction or emerging from a property set out in Column 2, in the direction set out in Column 3, during the times or days set out in Column 4 of the said Part.

COMMUNITY SAFETY ZONES

17.	When Official Signs are erected and on display, on Highways set out in Schedule A of this by-law, Part 24, Column 1 between the limits set out in Column 2, during the times or days set out in Column 3 of the said Part, are hereby designated as Community Safety Zones.

GENERAL

18.	(1)	This by-law applies only to Highways forming part of the road system under the jurisdiction of the Region.
	(2)	Sections 4(2), 4(3), 7, 8, 11, 12, 14, 15 and 16 shall not, if compliance therewith would be impracticable, apply to:
		(a)	ambulances, police or fire department vehicles or public utility emergency vehicles;
		(b)	Public Vehicles or Vehicles actually engaged in works undertaken for or on behalf of the Region or on behalf of a Public Transit Vehicle;
		(c)	Public Transit Vehicles; or
		(d)	School Bus vehicles.
	(3)	Where new signs have been installed and not yet included in Schedule A of this by-law, the restrictions or directions they indicate are enforceable in a like manner to the like section of this by-law.

PENALTIES

19.	(1)	Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended.
	(2)	The owner of any Vehicle may be charged with an offence for contravention of any provision of this by-law for which the driver of the Vehicle is subject to be charged and on conviction, the owner is liable to the penalty described for the offence unless at the time of the offence, the Vehicle was in the possession of some person other than the owner without the owner’s consent.

PROVINCIAL OFFENCES ACT

20.	(1)	Part II of the Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended, applies in respect of all Parking and Stopping infractions under this by-law.
	(2)	All such penalties prescribed under Section 19 shall be recoverable under the said Provincial Offences Act.

VEHICLE TOWING

21.	(1)	In addition to any other penalties provided for in this by-law, a member of the Peel Regional Police Force, Ontario Provincial Police Force, or a Provincial Offences Officer of an area municipality may, where a Vehicle is parked or stopped in contravention of Sections 7, 8, 11, 14(1) and 14(5) of this by-law, cause that Vehicle to be removed, taken away and stored in a suitable place.
	(2)	All costs and charges incurred for removing, taking away and storing a Vehicle pursuant to subsection (1) of this section, shall be a lien upon the Vehicle, which lien may be enforced in the manner prescribed by section 4 of the Repair and Storage Liens Act, R.S.O. 1990, Chapter R.25, as amended.

22.	The following by-laws of the Regional Corporation are hereby repealed, 57-2005, 91-2005, 27-2006, 43-2006, 53-2006, 56-2006, 4-2007, 5-2007, 6-2007, 7-2007, 8-2007, 32-2007, 33-2007, 34-2007, 35-2007, 61-2007, 90-2007, 94-2007, 28-2008, 29-2008, 30-2008, 58-2008, 40-2009, 42-2009, 54-2009, 55-2009, 66-2009, 91-2009, 92-2009, 102-2009, 39-2010, 40-2010, 47-2010, 48-2010, 76-2010, 77-2010, 78-2010, 79-2010, 54-2011, 95-2011, 31-2012, 83-2012.
23.	This by-law may be referred to as the “Traffic By-law”.
24.	This by-law shall come into force and effect on the date it is passed.

RESERVED BICYCLE LANES

25.		When official Reserved Bicycle Lane signs are erected and on display, no person shall drive, Park or Stop a Vehicle, other than a Bicycle or Public Transit vehicle in any portion of a Highway having been divided into clearly marked lanes for bicycle traffic, set out in Schedule A of this by-law, Part 25, Column 1, between the limits set out respectively in Columns 2 and 3 of said parts, in the directions set out in Column 4.
