THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 71-2012
 

A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 14 (Mayfield Road) in the City of Brampton.

WHEREAS Peel Standard Condominium Corporation No. 911, the owner of the lands and premises described as All of the Common Elements, Peel Standard Condominium Plan No. 911, City of Brampton, Regional Municipality of Peel, as in PIN Number’s 19911-0001(LT) to 19911-0046(LT) has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 28th day of June, 2012 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. Peel Standard Condominium Plan No. 911 is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 14 (Mayfield Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 11th day of May, 2012 between The Regional Municipality of Peel and Peel Standard Condominium Plan No. 911, and shown on a drawing number S-01.SIGN filed in Region of Peel Real Estate File ENC-2011060.

  2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
