D6. Patrick O'Connor, Director of Legal Services, Briefing and Request for Direction on Bill 206 - Ontario Municipal Employees Retirement System (OMERS) Governance Reform Legislation

RECOMMENDATION GC-230-2005:

WHEREAS Bill 206, An Act to revise the Ontario Municipal Employees Retirement System Act, is to be the subject of hearings before the Standing Committee on General Government of the Legislative Assembly of Ontario (the "Standing Committee");

AND WHEREAS Bill 206 would transfer plan sponsor responsibilities from the Provincial Cabinet to a Sponsors Corporation composed of representatives of the participating employer and employee members who fund OMERS (the "principle of autonomy");

AND WHEREAS Regional Council has in Resolution 2002-481 adopted on May 2, 2002 endorsed the principle of autonomy;

AND WHEREAS Bill 206 is for reasons other than its transfer of plan sponsor responsibilities unacceptable in its current form;

AND WHEREAS there has been a failure by the Province to engage in consultation, in accordance with the Memorandum of Understanding with Association of Municipalities of Ontario (AMO) and section 3(1) of the Municipal Act, 2001, before introducing Bill 206, which will have a significant financial impact on municipal budgets;

AND WHEREAS the Province has failed to provide an analysis of the financial impact of the implications of Bill 206 for participating employers and by extension the taxpayers;

AND WHEREAS the Association of Municipalities of Ontario (AMO) has taken the position that Bill 206 not be enacted in its current form;

AND WHEREAS Bill 206 contains provisions aimed at pre-disposing the Sponsors Corporation to create supplemental plans to provide optional enhanced benefits;

AND WHEREAS Bill 206 provides for the Sponsors Corporation to make decisions on the basis of a simple majority of its members, thereby promoting employer and employee block voting, reducing the likelihood of a consultative and reasoned approach to decision making and creating a prospect of fundamental change without consensus;

AND WHEREAS Bill 206 contains provisions which could remove fundamentally important decision making from the hands of employer and employee representatives into the hands of a third party arbitrator;

AND WHEREAS the responsibilities of the Sponsors Corporation will only be satisfactorily discharged by a Sponsors Corporation which enjoys adequate financial resources and expertise;

AND WHEREAS it is essential to employers and employees alike that the affordability of the primary plan or of any supplemental plan not be undermined by the imposition unrealistic solvency funding rules which are inappropriate to public sector pension plans whose participating employers are not liable to bankruptcy;

NOW THEREFORE IT IS RECOMMENDED that the position of the Association of Municipalities of Ontario (AMO) that Bill 206 not be enacted in its current form, be endorsed;

AND FURTHER, that support for the transfer of plan sponsor responsibilities by the Province to a Sponsors Corporation composed of participating employer and employee member representatives, be confirmed;

AND FURTHER, that the Standing Committee on General Government, the Honourable Dalton McGuinty, Premier of Ontario and the Honourable John Gerretsen, Minister of Municipal Affairs and Housing be requested to ensure the amendment of Bill 206 as follows:

a) to eliminate all provisions aimed at pre-disposing the Sponsors Corporation to create supplemental plans to provide optional enhanced benefits, leaving that determination to be made by the Sponsors Corporation free of legislated pre-conceptions;

b) to provide for decisions of the Sponsors Corporation to be taken by a two-thirds majority;

c) to eliminate those provisions which could remove to an arbitrator the authority of the Sponsors Corporation to make decisions respecting "specified changes" to such fundamentals as benefits, contribution rates and the creation of supplemental plans;

d) to phase in the assumption by the Sponsors Corporation of its responsibilities, in order to ensure that it has acquired the financial resources and expertise necessary to the discharge of those responsibilities as they are assumed; and

e) to remove the application of solvency funding rules from public sector pension plans;

And further, that the Province fulfill its commitment to engage in consultation before introducing legislation that will have a significant financial impact on municipal budgets in accordance with the Memorandum of Understanding with AMO and section 3(1) of the Municipal Act, 2001;

And further, that the Province undertake and provide a comprehensive analysis of the financial impact of the implications of Bill 206 for participating employers and by extension, for the taxpayers of Ontario;

And further, that a Region of Peel delegation to include the Chair and three area municipal Mayors, or their designates, register to present to the hearing.

PW-B1. Material Specifications for Large Diameter Watermains

Councillor Sprovieri put forward the following motion:

WHEREAS it is the objective of Region of Peel Purchasing By-law 62-2001 to ensure that Peel utilizes "the most efficient and effective procurement processes and decisions";

AND WHEREAS it is the objective of Region of Peel Purchasing By-law 62-2001 to ensure "that the methods of acquisition… which achieve the most competitive and responsive offers… shall be used whenever possible";

AND WHEREAS large diameter polyvinyl chloride (PVC) piping, which has been used in municipalities since the early 1960s, has a proven performance record, and has been shown to have competitive guidelines and economical benefits;

AND WHEREAS the report from the Province's Water Strategy Expert Panel, "Watertight: The Case for Change in Ontario's Water and Wastewater Sector", emphasizes the need for municipalities to use innovative and corrosion-free products to extend the life expectancy of municipal water systems and reduces costs;

AND WHEREAS expanding tender specifications for large diameter pipes for use in the Region's water transmission system will be in keeping with the Water Strategy Expert Panel's recommendations and make Peel's procurement process more transparent, competitive, efficient and effective;

AND WHEREAS broadening tender specifications to include larger PVC pipe is intended to provide Peel with more options, with the added advantage of increasing competition to the benefit of taxpayers, without deselecting current pipe materials;

NOW THEREFORE BE IT RESOLVED, THAT staff expand tender specifications for large diameter pipes to include PVC pipe for diameters up to 1200mm in its range of options for use in Peel's water transmission system.

Councillor Prentice put forward the following motion of referral:

That Items Related to Public Works - Item PW-B1, along with the proposed recommendation by Councillor Sprovieri, and the proposed amendment to the report recommendation by Councillor Moore be referred back to staff for further consideration, and a report, along with analysis on the findings of the American Water Works Association (AWWA) report due to be released in the spring of 2006.

The motion of referral was voted upon and lost.

Councillor Sprovieri agreed to withdraw his previous motion in order to allow the following motion to be put forward and considered.

Councillor Paterak moved the recommendation contained in the report:

That the Region of Peel exclude polyvinyl chloride (PVC) material for large diameter water distribution pipes, 400mm (16 inch) or greater in the approved list of material specifications and to include only concrete pressure pipe (CPP) and coated/lined ductile iron pipe (DI).

Councillor Moore requested a friendly amendment to the main motion, which was accepted:

That the main motion be amended to include the following paragraph at the end:

"And further, that Public Works staff submit a report to Regional Council regarding the findings of the American Water Works Association (AWWA) report, titled "Long-Term Performance of PVC Pipe" due to be released in the Spring of 2006, that reviews the opportunity to use PVC large diameter piping as it relates to the Region of Peel."

Councillor Saito requested a further friendly amendment to the main motion to insert the wording "at this time" after the word "exclude" in the first clause, which was accepted.

Councillor Fennell requested that the main motion, as amended, be split into two parts and voted upon separately.

Part I was voted upon:

That the Statement of Privacy and Information Practices, prepared pursuant to section 16(1) of the Personal Health Information Protection Act, 2004, S.O. 2004, c. 3 ("PHIPA") attached as Appendix I to the report of the Commissioner of Corporate Services and Regional Solicitor and the Acting Commissioner of Health, dated September 26, 2005, titled "Personal Health Information Protection Act: Impact on the Region of Peel", be approved, as applicable to the Region in each of its capacities as Health Information Custodian;

PW-A1. Local Improvement Project - Proposed Construction of a Watermain on Mississauga Road, Capital Project 05-1705 - City of Mississauga, Ward 8

RECOMMENDATION GC-238-2005:

That a 200mm (8 inch) diameter watermain be constructed on Mississauga Road from the existing watermain located at the intersection of Mississauga Road and Sevenoaks Drive north to 2725 Mississauga Road, a total approximate distance of 360 metres (1,181 feet), at a total estimated cost of $310,000 (including applicable taxes), under Capital Project 05-1705;

And further, that the Region of Peel portion of the funding in the amount of $235,644 be allocated from the Unallocated Water Capital Project 05-1000, financed from the Water Capital Financing Stabilization Reserve (R0241);

And further, that the portion of the property owners in the amount of $74,356 be set up as an external recovery and collected as a special assessment;

And further, that these actions will not affect the debt capacity of the Region as this type of financing is considered "self liquidating" by the Province of Ontario;

And further, that the necessary by-law be presented to Council authorizing the undertaking of the works under the Municipal Act, 2001, and imposition of a watermain frontage rate of $473 per metre ($144.17 per foot) and an optional connection fee of $3,942 per lot, current on the date the petition was issued, at the completion of construction;

And further, that the benefiting property owners be assessed annually for 15 years, including an interest rate which shall be determined at the time a by-law is enacted;

And further, that property owners be given the opportunity to commute the special assessment by advance payment at any time during the 15 year period;

And further, that the Regional Clerk forward a copy of this resolution and a "Notice to Amend" the tax rolls of the petitioned owners to the City of Mississauga.

PW-A2. Intersection Improvements on Bovaird Drive, Capital Projects 05-4245, 05-4250, 05-4255 and 05-4270, Document 2005-380P - City of Brampton, Wards 7, 9 and 10

RECOMMENDATION GC-239-2005:

That Document 2005-380P for an environmental assessment, detailed design, contract administration and construction supervision for the improvements for the intersections on Bovaird Drive at Dixie Road, Torbram Road, Bramalea Road and Mackay Street/Fernforest Drive be awarded to Totten Sims Hubicki Associates Limited in the estimated amount of $693,500 (excluding applicable taxes), under Capital Projects 05-4245 ($160,008), 05-4250 ($218,293), 05-4255 ($194,979) and 05-4270 ($120,220), in accordance with Purchasing By-law 62-2001;

And further, that authority be given to extend this contract for similar requirements to the limit of the approved budget when actual requirements exceed the estimate.

PW-A3. Engineering Services for Detailed Design, Contract Administration and Construction Supervision for Gore Road Rehabilitation (King Street to Patterson Sideroad), Capital Project 04-4035, Document 2005-146P - Town of Caledon, Ward 4

RECOMMENDATION GC-240-2005:

That Document 2005-146P for detailed design, contract administration and construction supervision of the rehabilitation of Gore Road (King Street to Patterson Sideroad) be awarded to R.J. Burnside and Associates Limited in the estimated amount of $298,018, (excluding applicable taxes), under Capital Project 04-4035, in accordance with Purchasing By-law 62-2001;

And further, that authority be given to extend this contract for similar requirements to be limit of the approved budget when actual requirements exceed the estimate.

PW-A4. Engineering Services for Detailed Design, Contract Administration and Construction Supervision - 2100mm (83 inch) Diameter Feedermain from Hanlan Pumping Station to Beckett Sproule Pumping Station, Capital Project 04-1205, Document 2005-070P, 2005-461P - City of Brampton, Ward 3 and City of Mississauga, Ward 5

RECOMMENDATION GC-241-2005:

That Document 2005-070P for detailed design, contract administration and construction supervision of the feedermain from Hanlan Pumping Station to Kennedy Road be awarded to Earth Tech Canada Incorporated in the estimated amount of $961,846 (excluding applicable taxes), under Capital Project 04-1205 in accordance with Purchasing By-law 62-2001;

And further, that Document 2005-461P for detailed design, contract administration and construction supervision of the feedermain from Kennedy Road to Beckett Sproule Pumping Station be awarded to Marshall Macklin Monaghan Limited in the estimated amount of $975,202 (excluding applicable taxes), under Capital Project 04-1205 in accordance with Purchasing By-law 62-2001;

And further, that the budget for Capital Project 04-1205 for the feedermain from Kennedy Road to Beckett Sproule Pumping Station be increased from $1,500,000 to $1,950,000, financed from York Recoveries ($323,942) and South Peel Water Development Charge Reserve Fund, R3520 ($126,058) in order to award consulting engineering services for contract administration and construction supervision for the feedermain from Hanlan Pumping Station to Beckett Sproule Pumping Station;

And further, that authority be given to extend these contracts for similar requirements to the limit of the approved budget when actual requirements exceed the estimate.

RECOMMENDATION GC-242-2005:

That a by-law be enacted to amend By-law 57-2005 by deleting the existing 60 km/h (37 mph) speed limit on Regional Road 5 (Derry Road) from Regional Road 1 (Mississauga Road) to the boundary between the Region of Peel and the Region of Halton;

And further, that a by-law be enacted to implement a 60 km/h (37 mph) speed limit on Regional Road 5 (Derry Road) from Millcreek Drive to the boundary between the Region of Peel and the Region of Halton;

And further, that a by-law be enacted to implement a 70 km/h (43 mph) speed limit on Regional Road 5 (Derry Road) from Regional Road 1 (Mississauga Road) to Millcreek Drive;

And further, that Peel Regional Police be advised.

PW-A7. Engineering Services for a Schedule B Class Environmental Assessment, Detailed Design, Contract Administration and Inspection for Bram East 600mm (24 inch) and 750mm (30 inch) Feedermains, Capital Projects 04-1181 and 05-1114, Document 2005-136P - City of Brampton, Ward 10

RECOMMENDATION GC-243-2005:

That Document 2005-136P for a schedule 'B' class environmental assessment, detailed design, contract administration and inspection services for the Bram East 600mm (24 inches) feedermain from future Humberwest Parkway & future Cottrelle Parkway to Goreway Drive & future Cottrelle Parkway and 750mm (30 inches) feedermain from future Humberwest Parkway & future Cottrelle Parkway to Goreway Drive & Castlemore Road be awarded to R.V. Anderson & Associates Limited in the estimated amount of $387,100 (excluding applicable taxes), under Capital Projects 04-1181 ($241,855) & 05-1114 ($145,245), in accordance with Purchasing By-law 62-2001;

RECOMMENDATION GC-244-2005:

That the Region of Peel enter into a Loan of Equipment Agreement with the Environmental Canada National Water Research Institute for the use and insurance of equipment required to complete a study on the Integrated Fixed Film Activated Sludge process at the Lakeview Wastewater Treatment Plant in Mississauga;

And further, that the Commissioner of Public Works be authorized to sign the agreement for the Loan of Equipment.

PW-D. Waste Management

PW-D1. Fewster Material Recovery Facility Equipment Disposal, Capital Project 99-6505 - City of Mississauga, Ward 3

RECOMMENDATION GC-245-2005:

That all equipment within the Fewster Material Recovery Facility be disposed of in accordance with the Purchasing By-law 62-2001;

And further, that the revenues gained from the disposal be used to offset the capital cost for redeveloping the Fewster Waste Management site into the Fewster Community Recycling Centre;

And further, that the monies received from the disposal be placed in the approved Fewster Community Recycling Centre Capital Budget 99-6505.

PW-D2. Port Credit Business Improvement Area (BIA) Pilot Project - City of Mississauga, Ward 1

RECOMMENDATION GC-246-2005:

That a cart-based waste and recycling collection pilot project be implemented in the Port Credit Business Improvement Area (BIA), which includes the purchase of garbage and recycling carts and the implementation of a communications strategy, for a total estimated cost of $62,500 (excluding applicable taxes).

PW-D3. New and Emerging Technology - Mixed Waste Processing Facility Agreement, Document 2005-276P - Town of Caledon, Ward 1

RECOMMENDATION GC-247-2005:

That staff be authorized to execute the Agreement between the Region of Peel and AmbientEco Group Ltd. for the design, construction and commissioning of a Mixed Waste Processing Facility, located at the Caledon Waste Management Facility;

And further, that upon successful commissioning of the facility, which includes establishing viable long term product markets by AmbientEco, the Region of Peel purchase the facility for an amount not to exceed $3,000,000 (excluding applicable taxes);

And further, that a New and Emerging Technologies project be set up for $3,000,000 (excluding applicable taxes), under Capital Project 05-6460, financed from the Waste Management Disposal Reserve, R1010;

And further, that upon successful commissioning, the Region assume operation of the facility and pay AmbientEco a royalty of $2.00 per tonne of product marketed.
