WHEREAS Real-T-Automatic Inc., the owner of the lands and premises described as firstly, PIN 14199-0369 Part Lot 5, Concession 4 East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Part 3 on 43R-32998 (formerly Part Queen Street East as stopped up and closed by By-law 68-2007 registered as PR1410199) and Secondly, PIN 14170-0160 Part Lot 5, Concession 4 East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Part 1 on 43R-32998, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 5th day of July, 2012 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. Real-T-Automatic Inc. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 7 (Queen Street), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 10th day of April, 2012 between The Regional Municipality of Peel and Real-T-Automatic Inc., and shown on Landscape Plan, drawing number L-1 prepared by Marius Ois & Associates Inc. on January 10, 2007 and revised on February 7, 2012, filed in Region of Peel Real Estate File ENC-11042.
   
   
2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law.
   
   
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
