BY-LAW NUMBER 71-2007
 

A by-law to authorize the construction of a watermain on Highway 10 in the Town of Caledon, and undertake such work as a local improvement.


WHEREAS the owners of properties abutting on Highway 10 in the Town of Caledon, as set out in Schedule A to this by-law, have petitioned for the construction of a water main on Highway 10 from Regional Road 12 (Olde Base Line Road) to approximately 800 metres (2,625 feet) north of Regional Road 12 in the Town of Caledon, hereinafter referred to as "the Works";

AND WHEREAS the Regional Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Works as a local improvement at the meeting of Regional Council on August 2, 2007 , was given to the public on July 19, 2007 and to the owners of the lots to be specially charged on July 4, 2007 , in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2007-793 passed on the 21st day of June, 2007 authorized the construction of the Works under Capital Projects 07-1705 and 07-1843;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That the Regional Corporation shall undertake the Works as a local improvement for the purpose of raising part of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation;
  2. That the Commissioner of Environment, Transportation and Planning Services or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;
  3. That pursuant to the Regulation, the total cost of the Works shall be financed as follows:

    a) the owners' share of the cost, estimated at approximately $128,235.30, the sum of $267.86 per metre of assessable frontage, shall be specially charged upon the land abutting directly on the Works and/or immediately benefiting from the works as set out in Schedule A attached hereto; and

    b) the remainder of the total cost of the Works, estimated at approximately $321,764.70 shall be borne by the Regional Corporation, from the Water Capital Financing Stabilization Reserve (R0241) in the amount of $97,128.21, under Capital Project 07-1705, and in the amount of $224,636.49, under Capital Project 07-1843.
