WHEREAS the owners of properties abutting on Creditview Road, Churchville Road and Walnut Road in the City of Brampton, as set out in Schedule A to this by-law, have petitioned for the construction of a sanitary sewer on Churchville Road (north of Steeles Avenue), Creditview Road (north of Steeles Avenue south of Queen Street) and on Walnut Road in the City of Brampton, hereinafter referred to as "the Works";

AND WHEREAS the Regional Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Works as a local improvement at the meeting of Regional Council on June 21, 2007, was given to the public on June 7, 2007 and to the owners of the lots to be specially charged on May 17, 2007, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2007-643 passed on the 10th day of May, 2007 authorized the construction of the Works under Capital Projects 07-2701 and 07-2170;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

That the Regional Corporation shall construct the Works at a total cost of $2,756,250;

1. That the Regional Corporation shall undertake the Works as a local improvement for the purpose of raising part of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation;
   
   
2. That the Commissioner of Public Works or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;
   
   
3. That pursuant to the Regulation, the total cost of the Works shall be financed as follows:
   

   a) the owners' share of the cost, estimated at approximately $904,010.75, the sum of $175 per metre of assessable frontage plus mandatory connection fee of $1,550, shall be specially charged upon the land abutting directly on the Works and/or immediately benefiting from the works as set out in Schedule A attached hereto; and
   
   b) the remainder of the total cost of the Works, estimated at approximately $1,852,239.25 shall be borne by the Regional Corporation, from the Wastewater Capital Financing Stabilization Reserve (R0242) in the amount of $1,508,239.25, under Capital Project 07-2701, and from DC Regional Wastewater Reserve (R3525) in the amount of $344,000, under Capital Project 07-2170.
