THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 61-2007
 

A by-law to delegate the Commissioner of Public Works to have authority to designate construction zones on Regional roads and authority to set a lower rate of speed for motor vehicles driven in the designated construction zone and to amend By-law Number 57-2005 being a by-law to regulate traffic on roads under the jurisdiction of the Regional Municipality of Peel.

 

WHEREAS the Council of the Regional Corporation on the 16th June, 2005 passed By-law 57-2005 to consolidate the by-laws that regulate traffic on roads under the jurisdiction of the Regional Municipality of Peel and which by-law is hereinafter referred to as "the by-law";

AND WHEREAS subsection 128(8.1) of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, as amended by the Transportation Statute Law Amendment Act, 2005, S.O. 2005, c. 26, authorizes a municipality to appoint a person with the authority to designate a highway or a portion of a highway under the municipality's jurisdiction as a construction zone and to set a lower rate of speed for motor vehicles driven in the designated construction zone;

AND WHEREAS the Council of the Regional Municipality of Peel has by resolution passed on the 31st day of May, 2007, authorized the enactment of a by-law to amend the by-law to delegate the Commissioner of Public Works to have authority to designate construction zones on a highway and the authority to set a lower rate of speed for motor vehicles driven in the designated construction zone;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. That Section 3 of Schedule I of the by-law is amended by adding the following:

    TRAFFIC SIGNS AND SIGNALS

    3 (8) The Commissioner is authorized to designate a highway or a portion of a highway as a construction zone and has the authority to set a lower rate of speed for motor vehicles driven in the designated construction zone.

  1. That Section 12 of Schedule I of the by-law is amended by adding the following:

    SPEED LIMITS

    12(4) Notwithstanding the maximum rate of speed otherwise provided in this section, where the Commissioner has set a lower rate of speed for motor vehicles driven in a designated construction zone and the highway or portion of it has been signed in accordance with the Act, then the maximum rate of speed in the designated construction zone shall be as established by the Commissioner pursuant to subsection 3(8).
