THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 16-2007
 

A by-law to establish the Sewer Surcharge Rate and Sewer Waste Disposal Charge and to repeal By-law 7-2006 titled the "Sewer Surcharge Rate and Sewer Waste Disposal Charge By-law, 2006".

WHEREAS pursuant to subsection 11(2) and Part XII of the Municipal Act, 2001, S.O. 2001, c. 25, the Council of The Regional Municipality of Peel ("Regional Corporation") has exclusive responsibility for the collection of sanitary sewage and for sewage treatment and the authority to pass by-laws imposing fees or charges for services or activities provided or done by or on behalf of the Regional Corporation, including fees or charges for the use of its sewage system;

AND WHEREAS the Council of the Regional Corporation, on November 22, 1990, passed By-law 90-90 to regulate the discharge of matter into the sanitary and storm sewage systems of the Regional Corporation and to make provision for the establishment of sewer rates and charges for use of its property, and for services and activities provided by the Regional Corporation;

AND WHEREAS the Council of the Regional Corporation on July 11, 2002 enacted By-law 43-2002 to impose fees for services and activities provided by the Regional Corporation, including the Qualitative Sewer Surcharges and Sewer Waste Disposal Charges enacted for the purposes of By-law 90-90;

AND WHEREAS the Council of the Regional Corporation on December 12, 2002, enacted By-law 66-2002 to amend By-law 43-2002 by deleting and replacing Schedule A to By-law 43-2002 with an amended Schedule A attached to By-law 66-2002;

AND WHEREAS the Council of the Regional Corporation on February 12, 2004, enacted By-law 27-2004, being a stand alone by-law to establish the Qualitative Sanitary Sewer Surcharge Rate and Sewer Waste Disposal Charge in accordance with Schedule A attached thereto;

AND WHEREAS the Council of the Regional Corporation on March 4, 2004, enacted By-law 1-2004 amending By-law 66-2002 to delete the qualitative sanitary sewer surcharge rate and sewer waste disposal charges under By-law 66-2002;

AND WHEREAS the Council of the Regional Corporation on December 9, 2004, enacted By-law 133-2004 to amend By-law 27-2004 to substitute the rates and charges set out in Schedule A thereto for the corresponding rates and charges set out in Schedule A to By-law 27-2004;

AND WHEREAS the Council of the Regional Corporation on October 27, 2005 enacted By-law 80-2005 to repeal and replace By-law 133-2004 and to establish the Qualitative Sanitary Sewer Surcharge Rate and Sewer Waste Disposal Charge in accordance with Schedule A attached thereto;

AND WHEREAS the Council of the Regional Corporation on January 26, 2006 enacted By-law 7-2006 to repeal By-law 80-2005 and to establish the Qualitative Sanitary Sewer Surcharge Rate and Sewer Waste Disposal Charge in accordance with Schedule A attached thereto;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on February 15, 2007, authorized that the by-law herein be enacted to establish the Qualitative Sanitary Sewer Surcharge Rate and Sewer Waste Disposal Charge in accordance with Schedule A attached hereto;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. This by-law and attached Schedule A outlining the Qualitative Sanitary Sewer Surcharge Rate and the Sewer Waste Disposal Charge is hereby adopted, enacted and imposed.

2. By-law 7-2006 is hereby repealed upon the passing of this by-law.

3. Despite the repeal of By-law 7-2006 herein, the Qualitative Sewer Surcharge Rate and Sewer Waste Disposal Charge set out in Schedule A to By-law 7-2006, on the day immediately prior to the day this by-law comes into effect, shall continue in effect up to the day prior to the date upon which this by-law comes into effect.

4. The provisions contained in subsections 5(1), 5(3) and 5(4) of By-law 90-90 and in Schedule C to By-law 90-90, both as amended by By-law 25-2002, imposing fees and charges for the use of the sewage system of the Regional Corporation, are hereby confirmed and re-enacted and shall be deemed to have applied in accordance with their terms as from the date of their enactment.

5. This By-law may be referred to as the "Sewer Surcharge Rate and Sewer Waste Disposal Charge By-law, 2007".

6. This By-law takes effect on the day that it is passed.

Schedule "A" to By-law Number 16-2007


The rates set out below are effective for all accounts rendered on or after the day this by-law comes into effect.

1. Qualitative Sanitary Sewer Surcharge Rate: $235.00 per 1,000 cubic meters.

2. Sewer Waste Disposal Charge: $13.00 per 1,000 gallons.
