WHEREAS the owners of properties abutting on South Sheridan Way in the City of Mississauga, as set out in Schedule A to this by-law, have petitioned for the construction of a sanitary sewer on South Sheridan Way from Kiran Court to approximately 100 metres (328 feet) west of Kiran Court in the City of Mississauga, hereinafter referred to as "the Works";

AND WHEREAS the Regional Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Works as a local improvement at the meeting of Regional Council on September 13, 2007, was given to the public on August 30, 2007 and to the owners of the lots to be specially charged on August 15, 2007, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2007-993 passed on the 2nd day of August, 2007 authorized the construction of the Works under Capital Project 07-2705;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That the Regional Corporation shall construct the Works at a total cost of $127,000;
   
2. That the Regional Corporation shall undertake the Works as a local improvement for the purpose of raising part of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation;
   
3. That the Commissioner of Environment, Transportation and Planning Services or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;
   
4. That pursuant to the Regulation, the total cost of the Works shall be financed as follows:

a) as to the owners' share of the cost, estimated at approximately $37,705.50, the sum of $450.00 per metre of assessable frontage and a mandatory connection fee of $2,100 per lot, shall be specially charged upon the land abutting directly on the Works and/or immediately benefiting from the works as set out in Schedule A attached hereto; and

b) the remainder of the total cost of the Works, estimated at approximately $89,294.50 shall be borne by the Regional Corporation, from the Water Capital Financing Stabilization Reserve (R0241), under Capital Project 07-2705.
