THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 5- 2006
 
A by-law to establish the Wastewater System Fees and Charges (Sewer Charge Rates) and to repeal By-law 81-2005 titled the "New Wastewater System Fees and Charges (Sewer Charge Rates) By-law, 2005".

 

WHEREAS pursuant to subsection 11(2) and Part XII of the Municipal Act, 2001, S.O. 2001, c. 25, the Council of The Regional Municipality of Peel ("Regional Corporation") has the exclusive responsibility for the collection of sanitary sewage and sewage treatment and the authority to pass by-laws imposing fees or charges for services or activities provided or done by or on behalf of the Regional Corporation, including fees or charges for the use of its sewage system;

AND WHEREAS the Council of the Regional Corporation, on February 24, 1977 passed By-law 19-77 to provide for imposing and collecting a Sewer Charge to cover the cost of the establishment, construction, maintenance, operation and financing of the sanitary sewage system;

AND WHEREAS the Council of the Regional Corporation, on October 10, 2002 passed By-law 53-2002, to amend By-law 19-77 as amended and By-law 43-2002, with respect to the application of a late payment penalty and remedies for non-payment;

AND WHEREAS the Council of the Regional Corporation, on December 12, 2002 passed By-law 67-2002, to establish the revised Sewer Charge Rates for the purposes of By-law 19-77;

AND WHEREAS the Council of the Regional Corporation, on February 12, 2004 passed By-law 26-2004, to revise the Sewer Charge Rates in accordance with Schedule A attached thereto;

AND WHEREAS the Council of the Regional Corporation on December 9, 2004, passed By-law 132-2004 to amend By-law 26-2004 to substitute the rates and charges set out in Schedule A to By-law 132-2004 for the corresponding rates and charges set out in Schedule A to By-law 26-2004;

AND WHEREAS the Council of the Regional Corporation on October 27, 2005 passed By-law 81-2005 to repeal and replace By-law 132-2004 and to establish the Wastewater System Fees and Charges (Sewer Charge Rates) in accordance with Schedule A attached thereto;

AND WHEREAS the Council of the Regional Corporation has by resolution adopted on December 15, 2005 authorized that the by-law herein be enacted, in 2006, to establish the new Wastewater System Fees and Charges (Sewer Charge Rates) in accordance with Schedule A attached hereto;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. This by-law, the attached Schedule A and the wastewater system fees and charges (Sewer Charge Rates) provided for therein are hereby adopted and enacted.

  2. By-law 81-2005 is hereby repealed upon the passing of this by-law.

  3. Despite the repeal of By-law 81-2005 herein, the fees and charges set out in Schedule A to By-law 81-2005, on the day immediately prior to the day this by-law comes into effect, shall continue in effect up to the day prior to the date upon which this by-law comes into effect.

  4. The liability for sewer charge and enforcement provisions, outlined in sections 2,3,4,6 and 8 of By-law 19-77, as amended, are hereby confirmed and re-enacted and do hereby apply to all accounts rendered on or after the date By-law 19-77 took effect.

  5. Sections 3 to 7 (inclusive) of By-law 53-2002, which amend both By-law 19-77 as amended and By-law 43-2002, and which were enacted by Council of the Regional Corporation on October 10, 2002 (pertaining to the payment of accounts, the penalty for late payment, the non-payment remedies and the waiver of interest charges), are hereby confirmed and re-enacted and do hereby apply to all accounts rendered on or after the date By-law 53-2002 took effect.

  6. This by-law may be referred to as the "Wastewater System Fees and Charges (Sewer Charge Rates) By-law, 2006".

  7. This by-law takes effect on the day that it is passed.

Schedule "A" to By-law 5-2006

 

The rates set out in section 1 below are effective for all accounts rendered from the date this by-law is passed up to and including accounts rendered on March 31, 2006. The rates set out in section 2 below are effective for all accounts rendered on or after April 1, 2006.

1. (1) Unmetered Consumption

A flat rate of $6.00 per month for consumers whose water consumption is unmetered.

(2) Consumption Rates

Each metered service shall be billed separately. The metered rates shall be as follows:

(a) $2.44 per thousand Imperial gallons metered, and

(b) $5.3750 per ten cubic metres (10m3) metered.

2. (1) Unmetered Consumption

A flat rate of $6.32 per month for consumers whose water consumption is unmetered.

(2) Consumption Rates

Each metered service shall be billed separately. The metered rates shall be as follows:

(a) $2.54 per thousand Imperial gallons metered, and

(b) $5.59 per ten cubic metres (10m3) metered.
