A by-law
to establish the Water Consumption Fees and Charges and to repeal By-law
83-2005 titled the "New Water System Fees and Charges By-law, 2005".

WHEREAS pursuant to subsection 11(2) and Part XII of the Municipal Act, 2001, S.O. 2001, c. 25, the Council of The Regional Municipality of Peel ("Regional Corporation") has the exclusive responsibility for the production, treatment, storage and distribution of water and the authority to pass by-laws imposing fees or charges for services or activities provided or done by or on behalf of the Regional Corporation, including fees or charges for the consumption of water;
AND WHEREAS the Council of the Regional Corporation on December 31, 1973 enacted By-law 9-73 respecting the supply of water, the management and maintenance of the waterworks system of the Regional Corporation and the establishment of water rates and charges;
AND WHEREAS Council of the Regional Corporation on July 11, 2002 enacted By-law 43-2002 to impose fees for services and activities provided by the Regional Corporation or for the use of its property;
AND WHEREAS By-law 43-2002 amends By-law 9-73 by amending Schedule A to By-law 9-73 with a new Schedule A to impose fees for water services and activities;
AND WHEREAS the Council of the Regional Corporation, on October 10, 2002 enacted By-law 53-2002, to amend By-law 9-73 with respect to the application of a late payment penalty;
AND WHEREAS Council of the Regional Corporation on December 12, 2002 enacted By-law 66-2002 to amend By-law 43-2002 by deleting and replacing Schedule A attached to By-law 43-2002 with an amended Schedule A attached to By-law 66-2002, imposing fees for services provided by the Regional Corporation, including fees for water services and activities;
AND WHEREAS Council of the Regional Corporation on February 12, 2004 enacted By-law 24-2004 to amend By-law 66-2002 by deleting the water rates and charges from By-law 66-2002 and to amend By-law 9-73 by amending Schedule A to By-law 9-73 with a new Schedule A to impose the water rates and charges in accordance with Schedule A attached to By-law 24-2004;
AND WHEREAS the Council of the Regional Corporation on December 9, 2004, enacted By-law 134-2004, to amend By-law 24-2004 to substitute the water rates and charges set out in Schedule A to By-law 134-2004 for the corresponding water rates and charges set out in Schedule A to By-law 24-2004;
AND WHEREAS the Council of the Regional Corporation on October 27, 2005, enacted By-law 83-2005 to repeal and replace By-law 134-2004 and to establish the applicable water rates and charges in accordance with Schedule A attached thereto;
AND WHEREAS Council of the Regional Corporation has by resolution adopted on December 15, 2005 authorized that the by-law herein be enacted, in 2006, to establish the new Water Rates and Charges in accordance with Schedule A attached hereto;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:

Schedule "A" to By-law 4-2006
The rates set out in section 1 below are effective for all accounts rendered from the date this by-law is passed up to and including accounts rendered on March 31, 2006. The rates set out in section 2 below are effective for all accounts rendered on or after April 1, 2006.
1. (1) Unmetered Consumption
A flat rate of $6.00 per month for consumers whose water consumption is unmetered.
(2) Consumption Rates
Each metered service shall be billed separately. The metered rates shall be as follows:
(a) $2.16 per thousand Imperial gallons metered, and
(b) $4.7372 per ten cubic metres (10m3) metered.
2. (1) Unmetered Consumption
A flat rate of $6.32 per month for consumers whose water consumption is unmetered.
(2) Consumption RatesEach metered service shall be billed separately. The metered rates shall be as follows:
(a) $2.28 per thousand Imperial gallons metered, and
(b) $4.9930 per ten cubic metres (10m3) metered.
