THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 35-2006
 
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 7 (Airport Road) in the Town of Caledon.

WHEREAS Orin Holdings Ltd., the owner of the lands and premises described as Part of Lot 20, Concession 1, as in RO1029141 and RO1076732 and Part of Block 50, Plan 43M-569, designated as Part 1 on Reference Plan 43R-20782 and Block 51, Plan 43M-569 and Part of Lot 19, Concession 1, as in RO664099, save and except Part 3 on Reference Plan 43R-21123 and Part of Lot 19, Concession 1, designated as Part 1 on Reference Plan 43R-21123, Town of Caledon (formerly Township of Albion), Regional Municipality of Peel, has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");

AND WHEREAS pursuant to Section 11(2) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 6th day of July, 2006 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That Orin Holdings Ltd. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 7 (Airport Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 10th day of May, 2006, between The Regional Municipality of Peel and Orin Holdings Ltd. and as shown on Landscape Plan L2 dated January 26, 2006 for site plan SP99-016C prepared by Martin Wade Landscape Architects Limited and filed in Region of Peel Real Estate File ENC-05075.00.

  2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Deputy Clerk and the corporate seal affixed thereto.
