THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 30- 2006
 

A by-law to authorize the construction of a sanitary sewer on Victoria Street, Louise Street, Lorne Street, McKenzie Street, MacDonald Street and McLaughlin Road, in the Village of Inglewood, Town of Caledon, and to undertake such work as a local improvement.

WHEREAS the owners of properties abutting on Victoria Street, Louise Street, Lorne Street, McKenzie Street, MacDonald Street and McLaughlin Road, in the Village of Inglewood, as set out in Schedule A to this by-law, have petitioned for the construction of a sanitary sewer on Victoria Street, Louise Street, Lorne Street, McKenzie Street, MacDonald Street and McLaughlin Road, in the Village of Inglewood, Town of Caledon, hereinafter referred to as "the Work";

AND WHEREAS the Deputy Regional Clerk has certified that the petition for undertaking the Work as a local improvement is sufficient pursuant to the requirements set out in Ontario Regulation 119/03, Local Improvement Charges - Priority Lien Status, filed under the Municipal Act, 2001, hereinafter referred to as "the Regulation";

AND WHEREAS notice of the Region's intention to pass a by-law to undertake the Work as a local improvement at the meeting of Regional Council on June 8, 2006, was given to the public and to the owners of the lots liable to be specifically charged on May 24, 2006, in accordance with section 3 of the Regulation;

AND WHEREAS the Council of the Regional Corporation has by Resolution 2006-330, passed on the 6th day of April, 2006 authorized the construction of the Work under Capital Project 06-2720;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

  1. That the Regional Corporation shall construct the work at a total estimated cost of $4,200,000;

  2. That the Regional Corporation shall undertake the Work as a local improvement for the purpose of raising part of the cost of the Work by imposing special charges on lots abutting on the Work, in accordance with the provisions set out in the Regulation;

  3. That the Commissioner of Public Works or the consulting engineer for the Regional Corporation shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Work under their supervision;

  4. That, pursuant to the Regulation, the total cost of the Work shall be financed as follows:

    a) the share of the cost to be charged to the owners, estimated at approximately $926,772 which will be comprised of the sum of $315 per metre of assessable frontage plus a mandatory connection fee of $1,550, shall be specially charged upon the land abutting directly on the Work, as set out in Schedule A attached hereto; and

    b) the remainder of the total cost of the Work, estimated at approximately $3,273,228 shall be borne by the Regional Corporation, from the Wastewater Capital Financing Stabilization Reserve (R0242).
