THE REGIONAL MUNICIPALITY OF PEEL
 
BY-LAW NUMBER 49- 2005
 
A by-law to amend By-law 52-2003 entitled "The Region of Peel Development Charges By-law, 2003" and By-law 45-2001 entitled "The Region of Peel GO Transit Service Development Charges By-law, 2001".

WHEREAS Council for the Regional Municipality of Peel enacted The Region of Peel GO Transit Service Development Charges By-law 45-2001 on the 4th day of October, 2001;

AND WHEREAS Council for the Regional Municipality of Peel enacted The Region of Peel Development Charges By-law 52-2003 on the 14th day of August, 2003;

AND WHEREAS it has become desirable to amend By-laws 45-2001 and 52-2003 in order to include definitions for "dwelling unit", "small unit" and "special care/special needs dwelling" and to remove the "large apartment" and "small apartment" definitions;

AND WHEREAS the Regional Municipality of Peel has given notice of the proposed development charge by-law and development charge background study and held a public meeting on the 14th day of April, 2005 as required by section 12 of the Development Charges Act, R.S.O. 1997 and Ontario Regulation 82/98 thereto;

NOW THEREFORE the Council of the Regional Corporation enacts as follows:

1. That By-laws 45-2001 and 52-2003 are hereby amended as follows,

The following definitions are added to Section 1 (Definitions) to immediately precede the definition of "temporary building or structure":

"small unit" means a dwelling unit as defined in this By-law that is 70m2 or 750 square feet, or less, in size;

"special care/special needs dwelling" means a unit intended for residential use, in a building containing more than three such units, which units have a common enclosed entrance from street level, where the occupants have the right to use in common halls, stairs, yards, common rooms and accessory buildings, which units may or may not have exclusive sanitary and/or culinary facilities and are designed to accommodate individuals with special needs, including independent long-term living arrangements, where support for services such as meal preparation, grocery shopping, laundry, housekeeping, nursing, respite care and attendant
services are provided at various levels, and includes retirement homes and nursing homes;

The definition of "large apartment" in Section 1 (Definitions) is deleted.

The definition of "small apartment" in Section 1 (Definitions) is deleted.

The following definition is added to Section 1 (Definitions) to immediately follow the definition of "duplex":

"dwelling unit" means one or more habitable rooms designed, occupied or intended to be occupied as living quarters for a single family or single household and shall, as a minimum standard, contain sanitary facilities, accommodation for sleeping and a kitchen, and for the purposes of this By-law, shall be deemed to include a special care/special needs dwelling;

2. That Schedule A to By-law 52-2003 is deleted and Schedule A of this By-law is substituted therefor.

3. That Schedule A to By-law 45-2001 is deleted and Schedule B of this By-law is substituted therefor.

4. Date By-law Effective

This By-law comes into force on the day after it is passed.

5. Short Title

This By-law may be cited as the "Region of Peel Development Charges Amendment By-law, 2005."
